Thats just too much bull for one day. Just when I thought that it was enough for 2008, you drop this bomb called "God's protection over this land" and made me read those illogical ideas. So this is what I have to say -
Can you prove the existance of God? Who is God? Where does he/she live?
You see, down the ages mankind have been told to think in a manner such that - anything that we cannot logically explain, we just come up with the rationale that "God did it". So for the things we can explain, we looks towards that knowledge, but for the things we cannot explain, we still try to explain to ourselves & others by saying - "God did this". And this is how the author is processing information, and this is everyone reading it will understand.
And this behavior is not a fault of anybody alive. We have inhereted these genes through thousands and millions of years. And those genes in us are designed to make us "blame or credit God" (whichever way you look at it) for everything we cannot explain. Now there will be some who will tell me that I am WRONG for saying "thousdand and millions of years" by arguing that Adam and Eve came just 2000 years back and earth was created in 6 days, and human beings were created some 2000 years old.
Human mind is extremely inferior. and for own inner sense of inferioirty, we want to tell everybody and our own ego that we know the reason for everything. And for the things we cannot explain, we explain such events to ourselves by using the argument "God is the reason behind those events". We cannot just accept "I don't know how/why it happened". Humans have to explain everything and a lot many times in a day, we explain events by telling ourselves - God did it.
One more thing, often times, unknowingly, we give more weightage to the writings from people who passed away as compared to the writings by folks who are still around. I think we should question everything told to us, everything feed to our brain - and we have that moral responsibility towards ourselves to question specially the things which are thrown at us with the message - "just accept it without qustioning", because religion and different version of the description of God cannot be questioned. It must be accepted the way it is.
I think that the greatness of America and its history is not because of the "Religion" or "God", but inspite of it. The fact that "Religion" or "God" is kept out of the Government is the only reason for the progress you see around. For millions of years religion was the center peice of every government, and so our ansestors lived in backwardness. Almost 99% of all inventions have been made in US, where State is "independent" of the "religion", although there are lot of nuts out there who wants to change this. As per the "religious folks" God will never protect a nation that intereferes with the work of religion, right? So why would "God" protect this land?
Anyways, I want to write for another 200 pages, but, I got to do this job and earn for my family, otherwise "God" will be angry with me.

I hate to disappoint you but there have been several instances of highly qualified IT professionals living in the US for a number of years who decide to jump the bandwagon and migrate to Canada due to the GC limbo. What happened to them ? Well some of them struggled to get the right jobs for a number of years before giving up, returning to India and finally taking up highly paid and respected IT middle or senior management positions.
Three of my friends went through such "stressful" experiences and now are happily working back in India. They still regret the decision to put their valuable $$$ into migrating to Canada, living in limbo for a few years while trying to get a compatible job in India and finally going back to India.
It is very unfortunate that people equate job opportunities to the population of the country. If that were the case then India and China would have the most job opportunities in the world because they account for one third of the world population but that's not really the case otherwise we all would't be here in the first place.
Opportunities are defined and provided by the economy. When you compare Canada to US, you might say that it's a smaller economy but remember Canada is a G8 country with such a strong economy that most other countries in the world can only dream of. US is the richest country in the world with the strongest economy so obviously other countries don't offer quite the same opportunities but Canada offers things that has become a dream for many of us... to be a citizen of the country where to permanently reside. Canada offers stability, certainty, hope for the future, and and an opportunity for everyone in your family to realilze their dreams as opposed to sitting at home for years doing nothing hoping that one day that EAD will come. Canada respects immigrants and welcomes them with an open arm quite contrary to policies in US where you are allowed to work but your family is not and even you are kept on the state of limbo for years and years wondering what your future holds in years to come. And better yet, you abide by the laws, pay taxes, do everything by the book yet the guy who just walked across the border has much better chances of becoming a permanent resident than you. Where is the respect and fairness for law abiding folks? That my friend is what is different with Canada. You get treated with respect and dignity and you get to decide what your future holds and not the US government.

I filed for my I-485, EAD and AP on July 2nd at the Nebraska Service Center. I am EB2 with a PD of June, 04. I haven't received any receipt notices. Any one in the same boat/ who has been through this process would like to share their views? Also, given the current fiasco, by when should I expect finger printing notice and, realistically, the green card?

Just sent emails and mailed hand-written and signed letters to Senators Boxer and Feinstien in Calif. both to their DC and SF offices.
Will send a few more to local representatives. Hope we can enable Congress to make this change in legislation before Election '08. If we can, it will be quite an achievement!

Folks, just a hunch but I don't think the bulk of the Dems are against Cornyn's amendment. I think the Dems will trade support for this provision in return for the repubs supporting the AgJobs bill if and when it comes to the Senate floor. No point in giving away a barter chip for nothing.

That's encouraging! I have lot more hurdles than the Bsc + MCA issue. My employer had filed my GC in EB3 and is now willing to refile under EB2, since I was promoted to a senior role. The company attorney though is hesitating to file under EB2, his reasons are as follows:
1. 3 + 3 degree will not be approved under EB2. ( This is in response to my question about using my Bsc + MCA. My current role requires Master's degree or Bachelor's + exp. I do not want to use the experience (9 years) gained from my current employer. So I suggested we could use my master's degree + 4+ years of experience that I have before joining my current employer. )
2. Attorney thinks Software Engineer role (EB3) and Principal Software Engineer role (EB2) are not 50% different. I agree that it is not 50% different. But my question to him was - "Does it (new role) have to be 50% different even if I don;t use the experience gained from the current employer". Haven't heard back from him yet.

I think the OP has some valid points. Certainly recapture lawsuit may work as the law does not say that allocated EB visas expire. Do not listen to nay-sayers, just do it.

Or for that matter can you legally proove that not applying for US GC is the barometer of patriotism towards India for an Indian?

The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.
To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense? I am sure that they will be doing various background checks to make the application ready for approval. It is not mentioned any where that how the pre-approval process is different from background checks? Are they the same or different? What processes are done during approval? I do not have any idea and hence I would like to keep the various checks and approval process separate.

Hey guys,
I have a question to all of you...
AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.
For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.
I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...
Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .
