My Priority Date Sep 2002 EB3
According to LC, my labor got approved on Aug 9th, but we received actual paper on Sep 9th .. So lost the chance to FILE 485
DOL took more than a month TO send papers ..
There is no point in blaming IV . They are the BEST ..
It is US Govt agencies who are lazy and ineptitude.
US did not get Civil Rights in one year .. it took decades of fight ...
IV is fighting for every one ..

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

Well, that's the job of the media. Our job is to get GC. Although the issues are true, I would still prefer having absolutely correct articles, so no anti-immigrant could point his/her finger saying "look, immigrants are spreading lies". Just like we bashed them when they were claiming that we pay less taxes. It was a good point to discredit them.
Media always narrates and presents it in a form where the commoner can understand, it needs spice.
Let us hope that we get more media attention and people start listen to us.

It is good. But .... There were many bills like this in past few years. But it is tough to get even considered unless if you come out a small number like 50k or less. Basically every year immigrant groups were asking unlimited number of GC for US Master degree holders. If they give unlimited gcs for US master degree holders then that number only will add 500K per year as Indian students only have numbers around 80k every year. So with some cap and exemption just for Phd holders will have a better chance of passing in congress.
I thought there was a bill along these lines last year, do not remember the name or number of the bill though. I would very much welcome such a bill though.

Yes, and unfortunately meaningless for me, because my current company won't do an H1 for me. When I joined this new company on EAD, they clearly told me that maintaining valid immigration status is my headache. They won't file any applications to US govt for me. It was made absolutely clear to me. :-(
To OP: Even if you moved to EAD you can come back to H1. If dates had not moved so much to make your PD current, what was your plan for your wife?
B1 visa of course. :-) . Hey, as I said, I did not think about intent issues at that time. Hindsight is always 20-20. But the deed is done. I never look back. In my dictionary, there is no such word as "should have". I either do something or don't do something. Only losers think they "should have" done something.
B1/F1 is not a good idea (immigration intent is obvious, and it will catch up with you at some point most probably during 485 processing and could result in a rejection). It looks like H1-H4 is the best option if you two lovebirds want to be together.

The root cause of most of your problems here seems to be the decision to invoke AC-21 using EAD instead of using H1. If you dont mind sharing: why did you jump to EAD knowing that it would mean your wife would be out of status and would have to return to India?
Too many issues at that time. Old h1 was anyway expiring soon. Desi bodyshoper employer was going nuts sqeezing me dry. He was demanding money for everything from H1 extension to giving out compnay letters for GC related issues and thousands of such reasons. But as I already said.. it's done..it's done...

Now, if you have used less than 6 years of H1, and then used AC21 portability, used EAD, abandoned H1 status and continued on EAD status and if the 485 gets rejected, there may be a way to reclaim the remaining unused portion of H1. It may involve going out of country and coming back in. Check with a lawyer, I dont know much and haven seen any case where someone who was on EAD status could go back to H1 status. Usually H1 to EAD is a one-way street, especially if you have already used up the 6 years of H1 stay in country.

This is not the case for me....but during a discussion with my attorney and other friends contacts they said if you do not attach the medicals now you may get RFE at a later stage...which you can resolve it.
I bet any RFE can be articulated with reason by attorney if they are smart enough.
This is something I heard...but do not hold me on that. Please check with your attorney too and make a decesion.

An Indian man walks into a bank in New York City and asks for the loan officer. He tells the loan officer that he is going to India on business for two weeks and needs to borrow $5,000.The bank officer tells him that the bank will need some form of security for the loan, so the Indian man hands over the keys to a new Ferrari parked on the street in front of the bank. He produces the title and everything checks out. The loan officer agrees to accept the car as collateral for the loan.The bank's president and its officers all enjoy a good laugh at the Indian for using a $250,000 Ferrari as collateral against a $5,000 loan. Very well written article.
American have heard ad nauseum the concept of anchor babies from Lou Dobbs and his ilk.
We need to introduce them to the concept of "ANCHOR JOBS" ie what we do. We anchor the jobs of leading industries to the USA so that the rest of the economy can continue to flourish based on those jobs and the spin offs.
We need to let the ordinary american know that it is in his/her best interest for us to help keep cutting edge american industries here.
The few lazy american techies who make 6 figure salaries and yet still want more, need to be exposed for what they really are.............protectionist losers who put self interest above country. Unfortunate that they take that route rather than see the real shortages in the industries of tomorrow. They really are in pole position to make money out of it as well, if they just developed some entrepreneurship.
