Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)
We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.
Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
Also have industry people talking in favor of better immigration policies.
(we could hold it in some other company or a common area .. anything works)
Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.
We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.

I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

Agree 100%. Atleast when Bush was in office there were bills introduced that encouraged skilled immigration Eg: Those who have been around for a while would remember the Cornyn-Kyl bill from 2005.
Everybody likes to talk about the Clinton era, but don't forget that Republicans had majority then. So we may see good things happen after the November 2010 elections if dems lose majority in both house and senate. And it will be good for Mr.Bamster to govern from the center going forward than to hang out with the far-left, may even fetch him another 4 years.

That time the deomcratic party wanted amnesty but "their" version of the bill never got a chance to be heard by the repuiblican leadership who had control over teh agenda. You said you are standing trial. At the trial if your wifes says you did not hit her or hurt her. What is the jury going to discus on. I think there is some thing missing here. They just do not want to waste time of the jurors on a simple thing. Your wife can meet the DA in person and request for dismissal.

Nobody here even comes close in identifying which are the eligibility criteria. Everybody hopes for one or the other.
Meanwhile one thing is for sure:
Every application filed after July 2nd, is filed AFTER they closed the doors oficially! How are we in the same class as the people from July 2nd ??? Just because we prepared for filing ??? Isn't that a bit weak in the eyes of the law ?
Just talked to my lawyer..he said even if we win the case...eligibility is based on the court order...court order may allow every one or only limited people who are in the class action...and in murthy.com they clearly mentioned that, USCIS MAY look at the apllications very closely who are in the class action....who wants that..

PD = Date on which your labor application received.
My 140 says it is the date on which my labor application received. i believe it is the case with all.
Please contact USCIS to get that corrected.

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.
What are you talking about? There are a limited number of green cards each year. The US wants the best of the best to get these green cards. Therefore, more preference is given to those with a higher degree or more experience. What's unjust or unfair about that? The trick is to look at things from the American perspective and not from the immigrant perspective.
And for the record, I am an EB3.

According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.
Disclaimer: Please do not take this granted and always consult your immigration attorney.
I would like to differ on this, the person applying for a renewal of AP does not have to be physically present in the US until the AP is approved. Our attorney confirmed this and if you notice on the AP application form it states if the document has to be mailed to a different address other than USA.
Our attorney said one can apply for a renewal even from a different country, the clause that one has to be physically present in US is only for the initial I485 and AP application.
I have applied for AP renewal on June 23rd and am traveling next month to India for 2 months will be back before my current AP expires i.e. Oct 10th. My attorney actually asked me to apply for renewal before I leave for India.

In my case im here working for a canadian company with offices both in US and Canada. So Im moving to Canada in Oct to maintain my PR card. But you may ask why I need to maintain it and just not continue here filing 1 year h1s !!
costs 3k+ for the company every year !
also you never know when the rules here will change and i will get a gc or the rules may change in such a way that i will never get a gc.. so if i atleast have a canadian PR card and then may be become a canadian citizen i can come back here and work on a TN visa or whatever...
and also for now i will be maintaining my H1 atleats for another 1 1/2 years by getting paid here in the US. I will use my friends address here as my address and i will be telecommuting from Canada. i know i will have to pay US taxes + canadian taxes (additional). Anyone else doing this ?
Big reason im staying in North America is Health reasons...

King will, as usual, will come up with alot of amendments again. By the way, they have to finish with the horse bill and then they will come to our bill and then they have to finish the nurse bill. All the bills along with the Mr.Kings amendements have to be done in 2hrs because it starts at 3PM and ends at 5PM.

Politicians always want to keep issues alive! If issues go away, there is nothing to fight, nothing to talk in the elections; without issues you cannot get "bulk" support from any specific group! So, the so called CIR will remain a "perpetual carrot". It will never happen in our life time.
We are all mature, educated people from a highly politically conscious environment! So...we are not naive, I am sure!
I take this opportunity to summarize a few things which have happened in the context of "long term indentured" labourers like us:
1. Quantum jump in terms of H1 ---> about 8 / 9 years back [happened because of pressure from corporations and their lobbies, nothing to with us. they wanted cheap labour and more profits!]
2. "Free for all" L1s ---> There is no cap, no specialty skill requirement. Not even sure if this has a min wage like H1. Why? Only because it serves the interests of the corporations to import 80% of the work force in any project!
3. Yearly H1 extensions based on Labour approvals / 3 year extensions for I 140 cases ---> When the "slaves" started returning after 6 years (without GCs being approved) the corporations growled and again the lobbies worked day and night. This has nothing to do with our pleading!
4. AC 21 ---> This is a good feature with a humane angle, but again there is NO WRITTEN MEMO permitting the employees to switch jobs 6 months after receving their EADs! This has been clearly articulated in a new item by Murthy.com! So AC21 is NOT a fool proof mechanism!
If the employer withdraws his I 140 there is a fair chance that 485 might be denied. (as per Murthy.com, there are a number of cases where such denials have happened). Again INS will never issue a memo, because it will antagonize the corporations
5. EAD / AP merger ---> this is a minor change in procedure, an admin fix! This is not a policy change. Full credit to several immigration forums and pleadings. However, this is not going to help many of us as our AP / EAD dates vary by several weeks and we might not be able to file them together
So, after 10 + years pleading, we have been able to get an admin fix :) That is amazing!!! Under the circumstances we cannot even dream of any legislative support or correction! Instead of Chinese / Indians in the endless line had citizens of the EU nations been affected, everything would have been fixed ages back!
Everyone is interested in the illegals and their "hard working" school children! That is because of the money, muscle, vote power they wield! Even if they were to have 1% of the law on their side, they would have achieved their objective ages back! They are holding us hostage because we have 100% of the law on our side and they have 0% of the law on their side. Otherwise, why should we law abiding immigrants be grouped with people who jumped fence?
Think...does this make sense at all? Correct me if I am wrong! I will accept my mistakes with all humility!

Youngsters in the early to mid 30s with "non US citizen kids" please think seriously. Do not waste your time in this mess for decades. We have all suffered for 10 - 12 years now and have no options. If you cross the age of 40 then you cannot immigrate to any western country because you will lose in the "points system". It would be a good option to live in countries who have a clear cut time bound program which does not discriminate on the basis of your nationality.
When the corporations wanted you and I, H1 was increased - no one was bothered about your nationality at that time. Today when we want a future for our family and kids, people talk about quota and diversity! This is what is known as "Having the cake and eating it too"
Remember, the system has been designed to support and ensure long term indentured labour to sustain the greedy corporations! There is no place for empathy or compassion. It is business! It is money! Free market enterprise works this way!
If we are expecting miracles, we are chasing a mirage!!!
