we all suffer, waiting for the administration/immigration policies to be humane to us..but honestly they've only gotten worse every year. the only good thing was the july bulletin but that also was becoz of the pressure from the big companies who'd already paid big bucks for immigration/attorney fees.
honestly here or back home no one really cares...we will get old, die tryin' perhaps but its true "might is right" and that is how the US embassy treats us.

We sent an email to CISOmbudsman.Publicaffairs@dhs.gov and they gave the update, even though the online status didn't update for more than a week.
The Ombudsman office gave a response with in one business day.
Found out from the Senator's office that my case has been approved. Attorney was able to call and confirm. No change in online status though.
E-filed on May 5th

I tend to agree with your interpretation that "NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE" refers to those beyond 140K. The language of law is always beautiful, isn't it?:)
Anyhow, I still think it merits a deeper investigation and consultation with attorneys.

Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
EB3ROW may move also.
The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

So they'll answer which would be in favor of their client. Inspite of several questions of this kind on her forum she or any of her attorneys have not cited a single example of anyone running into trouble on this issue.

I think ex-employer have revoked I-140 already but not sure (He threaten me in 2007 that he will do so in I invoke AC21).

Ya...Atleast, they should allow us to file EAD. In that case my spouse can work. She did not get H1b this year(because of lottery system). She has PHD in CSE and sitting at home.
If she has a PHD in CSE she should look for a job get H1 and file Green Card in EB1 all off this can be done in 6 months! What's holding you back???? :)

IV has the clout now to approach agencies, explain to them our argument and see if we are able to convince them for short-term reliefs. It is just a matter of trying.
I'm smiling. We will certainly try, but the part above (clout etc) would be an overstatement of our current levels of access. :)
Note that these are the same agencies that have been resisting our efforts to get even the most basic breakdown of data.

We might be looking at it the wrong way. The question is whether outsourcing is bad. Maybe thats not what the question should be. My view is that just like competition, outsourcing and globalization are facts of life. You can fight it, but it will not get you anywhere.
If you think of globalization and realize that the whole world is a marketplace then wont the whole world be a competition for your job?
When I think of outsourcing, I think of just another competition for your job. In some cases though when the entire department is being outsourced you are part of the herd. The same can be said for entire departments laid off.
