Did you by any chance speculated to him that application might be in TSC based on LUD on I140?
When he was noting down all my info, I mentioned about LUD on my I-140 (approved) for 8-5-07 and he said.. it does mean anything since they still need to mail applicants receipts no matter what stage is your application is processed under.

Gurus and "New" Permanent Residents,
Did any one send a streamline email to NSC and did any get a better response then the "automatic script" response that you get from NSC?
If you did get a positive response then can you share on what exactly you had in the content of the email?

As far as my knowledge goes, there is no streamline email for NSC. We did send emails to NSCSfollowup and SCOPPSCAT .. and got standard script response for both.

I think the developments are great!!! USCIS secretary Emilio Gonzalez posting a message on the USCIS web site - this is GREAT NEWS!!! What we're doing is being acknolwedged!! It's a sign that this is working, and those up there are forced to take notice and act on it....
It may have sounded ridiculous initially, but GANDHIGIRI seems to be working even in our case!! Some times you have to think unconventionally, out of the box (to use a much abused and cliched term), innovatively, to get the kind of results you want.
Nobody thought sending flowers would change the hearts of USCIS/Dept of State.... and they would somehow agree to accept our AOS applications...
The fact is, this development means we're getting the deserved attention, imho. Can that can be anything but good news... ?

I'm not blind to stereotyping in this forum or elsewhere. It's not you vs. them kinda thing. You ARE stereotyping based upon some TRUE things but it is still stereotyping, isn't it.
Also, you understood some of my comments wrong. All I was saying is that due to big ISV's like TCS/INFY/WIPRO and mushrooms of bodyshops the actual worker gets pennies on a dollar and they keep the booty. So it's not the worker who causes wage depression it's the circumvention of the spirit of law that these companies do which causes it. I say "spirit of law" because they still stay within the legal framework. As far as offshoring is concerned it's a big discussion in itself and forces of capitalism and globalization are at work. None of us can prevent that but we can counter it by moving up in the value chain.
The scenario you described about modus operandi of big Indian ISV's is 100% correct but to generally imply that Indians are 1/5th as good as Americans when it comes to IT (50 member team vs. 10-12 member team) is a supremacist attitude and completely untrue.
It is true that the Indian counterparts are usually of much younger age but rarely substandard for the job. Companies realize that IT is no-longer considered rocket-science and they can save a few bucks. Try to think objectively keeping personal impact aside.
Now regarding overall economic input of immigrants there are issues broader and larger than you mentioned. Some of the smaller points you mentioned are true but you are completely missing the big picture. We can discuss that in a different thread :)

Among the 65K every year you'll find people from all skill levels, cream-of-the-cream to just-about-ok, and a few rotten-apples too. The immigration system is not designed to test skill level. Overall it's old, irrelevant and doesn't help anyone. It needs to be re-designed but unfortunately people are divided on fake lines and ignore the real issues or rather real solutions.
Although you have said it differently but you are right that solution to mine and your problems lie at the same spot, a modern, common-sense, immigration system that promotes best-and-the-brightest (Indian and American) and discourages exploitation.

I think Vonage will offer this free International calling for few months till it meets its target of new subscribers and then start charging per minute later on or in an indirect manner.
Once the new charges come into force the happy subscribers will not be able to cancel the service immediately due to cancellation charges and moreover since all other providers will be more of the same, Vonage wud then retain most of the customers

Remember you are talking about INDIA which is not US. you need broadband connection and Electricity for VOIP and you know the availability and reliability of both in INDIA.

The authenticity of that case is not clear. Someone claims his friend had issues and we do not have any details.
I used AC21 few months back and went through the NOID ordeal.
Our volunteers working on this effort are in the process of identifying authentic AC21 cases that got denials though they did everything to the law and are in process of filing MTR.

He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.
Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?

One of the iv member, has stated that the I485 has been denied for his friend, upon withdrawl of 140 by his ex-employer. His ex-employer has informed USCIS, that the employee left the job on his own. Also, he quoted that "USCIS denied I485 because, ac21 can be used in case of layoffs only , not switching for jobs"
In your letter you are requesting to give RFE/NOID before denial, but the fundamental reason for denial is different in the above case. what is use of getting RFE/NOID, in that case?

As these members have observed, we all know that any one who has filed for AOS/I-485 can potentially be hit with this issue, especially in the current job market situations. If you believe in the old adage prevention is better than cure, this is an action item you have to subscribe to. It will be only a matter of time the number of such denials is going to spike.
In recent weeks there has been a spate of I485 denials by USCIS in the AC21 cases. In most of these cases, the underlying I-140 has been revoked by previous employer. But AC21 regulations and related memo�s require that I485�s should not be denied based on that � provided I485 has been pending for more than 180 days and the applicant has changed to a new job that is same or similar. USCIS has been rejecting cases without even issuing a NOID � again required by AC21 regulations. So USCIS is not following AC21 regulations and related field memo�s for whatever the reasons.
Obviously this will have a very bad impact on us � in addition to tremendous amount of stress it can have very bad economic implications including loss of job. In the current economic conditions we cannot afford to lose the job change flexibility provided by AC21 regulations. IV has started a campaign to fight this.
After a brief campaign to write to Ombudsman, it has been decided to intensify this campaign and write to various officials in USCIS hierarchy. IV core members have been actively involved in coming up with a strategy and are actively supporting this effort.
