Every 485 applicant needs to submit birth certificate. If in regional language then get it translated in english. I dont know any place/person for translation, but you would need to submit english version.
Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

:) I will make sure to ask the Attorney / firmto overnight it via FedEx on Jun 1. In the meanwhile, I am working on the check list of documents, vaccines list and take medical appointment. Already prepared I-485 filing documents way back in Aug 2005. Maybe the attorney will send a set of new forms, I don't know; I will complete in one day.
late last month my father passed away and I had to fly back to Australia to attend the funeral. My lawyer and I were already in the process of preparing my i485/ead/ap. They arrived at the service centre on may26 and I left the US shortly after midnight on the 27th ( talk about close). My lawyer told me that as long as I was present in the US the day that the Service centre recieved my applications, I was ok. I also had my L1 re-stamped in Sydney before returning. :)
So based on my experience, no you dont have to wait for reciept of filing, just must be in US when filled.

My appointment was on the 12-Dec. Visa was approved immediatly - was told I'll get it in 7 days - but haven't received the passport yet 56 days to date. I receive the same response when I call.. that its under PIMS verification. No ETA of when I can expect it to be done..

Chandu, what if a person has used only 4 out of total 6 years of H1 period. Still it needs stamping?
Yes, unless your h1b comes with a i 94 extension - you have to get it stamped as per my understanding. Only h1b transfers come with i 94 extensions attached. Gurus can correct me if I am wrong

What I am suggesting is that the right time to take this up is when a recession is not in full swing. Between 2004 (when this law was enacted) and 2007 was a great time to pick this battle. Maybe another year down the line would also be a great time to pick it. Picking up this particular battle right now would probably make YOUR and MY lives much more difficult in the medium term.
I disagree. By not reporting the fraud at workplace, it puts rest of workforce not at level playing field.
Like you and the OP - I am a selfish individual. I will pick up only those fights which are in my interest. I believe that this particular fight is a lose-lose proposition in the current climate. I am disputing your (and OPs) belief that this will be beneficial for you/me/rest of us.
Lets take the example of the same Goldman Sachs manager. Tomorrow ICE comes to him and says you need to get rid of these 50 guys under you. What will he do? He cant increase the budget in the current environment. So he probably will hire a couple of GC holders/Citizens and replaces the whole division (with 50 GC/Citizens besides the 50 'violators') with an offshore team.
You are right. If you are not impacted by fraud, one will be least interested in reporting the fraud. Only when you get impacted, the fraud appears real and serious.
To give you example, There are only 3 people on H-1B at my workplace and none on L1 visa status, so no one cares here about this issue.

In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. They had made it very clear how they allocated 'available' visa numbers after AC-21 was introduced, and I am sure they consulted with the law-makers.
It's almost funny to read that they consulted with today congress. How would they now of the intentions of the congress in 2000?
According to Ron's post, 70% are from India and China, and Mexico is also reaching the ceiling. They realized that the only way to shift those numbers is to give more visas to India and China. The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.

Type in congressman your city name in google or yahoo search. It will give you various names for your senator and congressmen. Call them and give them your name FN LN, DOB, Alien number and fedex / delivery tracking mnumber. They will call you back with relevant information.

Where did you get the A number of the applicant? I checked my I140 approval there is no such number on it in front of Beneficiary name and in the bottom. Even in my I131 application the A number box is blank. Is there any other way to get this A number.

My immigration doctor told me that if i had chickenpox in childhood i do not need the varicella vaccine? Which i did at age 5. Please, let me know if anyone else was told the same , i will be going back to him on Wednesday for the physical exam. I don't want to get a RFE on that.
You need proof that you had chicken pox- a relevant letter or prescription issued at that time. Your Doctor can also order a test to find out the antibodies- the presence of which proves that you had chicken pox, but my Doctor told that it is expensive and easiest thing is to just take a shot. (This is what we did for my Sons school admission here, same provision is applicable for immigration I guess)

I am all for it, and would support it in whatever way possible. Although not sure how it would work. It would require a gigantic change in the US laws.
I am here for past 11 years paying all possible taxes. Fortunately i was able to file 485 in 07, thru my second gc filing. Bought a house in '06 in a bold move, with the hope that gc would come thru sooner or later. Overall happy with the move to my own house (though the house value has dropped considerably since). Waiting is really painful, but I'll continue to maintain a positive outlook till then.
Can any one take a lead on this and volunteer?. As I am not an expert in it, I am asking any of the members of IV to take initiative. We will support in what ever way..

We are in the middle of a fight to get recognised of our problems and for sure the director responded to our non-violent protest.
What we do next will count.

Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.

Multiple 485 and EAD filing

Hi,
My wife and I both got our LC approved. She filed I-140 and I-485 concurrently for both of us in Nov.2006 (Nebraska Center), based on her LC. Then I filed I-140 and I-485 concurrently for both of us again in Jan,2007 (Texas Center), based on my LC.
The EADs she applied got aproved pretty quickly. Several days ago, my EAD applications got denied. The denial reason is, we already have approved EAD.
Originally our plan is: My wife will switch to a Finance related job soon (her LC is based on Software job), I will wait for GC. (The reason we still filed for multiple 485 and EAD is that we want to postpone the decision on who should wait for GC). Now I'm totally confused on whether she can use the EAD, and whether I can renew the approved EAD (because they are based on her application).
Any inputs or clarifications will be greatly appreciated.

Yup. One should be ready for the consequences when they apply. Think carefully before you do something and do not make any errors in decisions.There are both advantages and disadvantages. A lawyer office that has done this in the past quoted a case to me. Another non-desi expensive lawyer who always gives accurate information and is not greedy told me that he would not advice multiple filing.

Concentrate on action items and work harder than ever, which can bring a great relief to entire EB community. It does not matter how many times we failed or succeeded, every attempt we are an inch closer to our ultimate (IV) goal.

If this goes through , the next step is to fight for review of all EB1 and EB2 applications thoroughly for misrepresentations in the job descriptions to make sure the job they do indeed requires masters degree and to make sure same job is not being done by a person with bachelor degree in the industry (Not just same company).
To make sure when they file for the GC they have the real INTENT to work for the company. working for SIX months is not intent. If all the issued green cards are canceled if they don't work for the company, we will have enough numbers for genuine candidates in all groups.
How about even extend this to citizenship ? I have some ideas in that area as well !!

Finishes BSc in life sciences.Stays in university hostel for 7-8 years preparing for job and finishes PHD in life sciences in the process(You know how they go ). As a matter of fact, people like you, irrespective of the qualifications, should never be allowed to immigrate to anywhere. You should remain in India or should I say "arsha-bharatha"?

Conspiracy? DOS is part of bush administration. And since the president is dissapointed because of CIR. He wants a back lash from immigrant community?
It is going to be true. otherwise mathew wont shut down his work and post that AILF is going file law suit.
I am suspecting that they made current because of lobby made by some big heads inorder to get support to pass the immigration bill.
Since the immigration bill failed, DOS is going back to retrogression.
