Slow and steady is good in contrast to arbitrary, jerky movements, suddenly forward and then suddenly backward into the ice age, which does only harm and no good to anyone. Like they did it in July 07 and then closed down the gates.
I'm hoping EB2-I marches right into 2005.
Hopefully, EB3-I will also see forward movements well into 2002. Let's keep all our fingers crossed.

Fantsatic news. I think we have to unite for this big event - this is the BEST time to get our voice heard. If illegal immigrants are voicing why not We? Most of us are here for atleast close to TEN years and contributed for this economy. PERIOD.

Hi Diptam and others, few questions about FOIA,
1) My employer does not want to share the original I-140 either, so i too want to apply via FOIA, do you know what is the cost of applying ?
2) If we apply, will the employer get to know ? does uscis send some notification to the employer that the employee requested a copy of I-140 approval notice?

Bottomline is they do not want to give us Greencard just use us and fool us. I am sure this 485 being current is big melodramatic thing.

at least they are approving 2003/2002 PD applications as we have seen.....now that surelymeans they are working a little bit....
Whether they are short on staff, or whatever teh reason maybe, the bottom line is our complains to any higher ups/Senators..etc will just fall on dead ears as we are not the Voter Base.....

I guess the polling on PD basis is futile it will give people false hope....
Only folks with ND prior to current processing times can expect to have a chance at appoval...I see many people over here beyond the processing date window and are still hoping to get approved....
Let's see if this theory is right or not come september.....if only my lawyer had mentioned that ND over rides PD I'd have forced him to file on July 2nd and not wait till July end....

Your point of ND vs. RD (vs. PD even) is certainly valid, esp. given the randomness of dates that the USCIS follows. However, three things to keep in mind are -
1. Last Aug and Sept ('08), neither ND nor RD theories worked, if you believed all the dates entered under .com. Approvals were quite random - some cases with ND beyond published dates were approved, which led us to believe they were processing in order of RD, but no FIFO was followed based on RD.
2. The dates published recently (09/15/2007 at NSC and 08/30/2007 at TSC) are as of June 30, 2009. It has been nearly two months since and an update is possible. Also, by admission of the USCIS, these dates are not exact, only estimates of what cases are being worked on.
3. Finally, these dates do not serve as guidance for IO to approve cases; they serve as an indication to us applicants as to which cases have been processed thus far. And they help determine if we can file an SR.

Thanks for the reply. I am not sure how that will divide the community. As per USCIS laws currently, the spillover is horizontal. Based on this assumption, will EB3-I get any visas if the recapture is successful?

I have seen it happening a lot of times. You would not believe, I have seen management floating dummy projects, just to burn left over money so that they can claim the same amount next year. If they do not burn the cash, it would be hard for management to secure the same amount of budget very next year. You know, Sanju is so true! I think flowers comaign is a good idea. But I wanted to know why don't we send letters and emails to Mr.Aytes and USCIS Director and probably HEads of DOS to issue the 182,000 unused visas since 2000 now so USCIS can work on those visas from July to October.
NYTimes article mentioned that DOS officials did not want this years number wasted like the 182,000 visas got unused since 2000.
Can someone come up with a writing so we can all send emails and postals mails with this request.
They need a mandate from the congress to do it, once in the past, during the clinton administration, they got the "GO" to use up unused visas.
The current administration dosent want to do that, that is exactly why we need more awareness in the media and the congress.

If your case is older than 12 months from the date of judgement you can have your case expunged from public records. As of today your's is a public record and is on every entry point in the country. As per immigration laws the IO has the authority to turn you back if you have been found guilty. The best for you is to have the expungement of your case and no one will have the access to your case except FBI.. This may take anywhere 2-3 months from the date you file for expungement..
Avoid travelling till your expungement is done..to be considered for expungement there should not be any other sace pending against you.
Good Luck.. talk to your attorney and file for it even if you are not travelling it will be good for you for future employment etc. also..

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?
