Sanju, add78 and FinalGC and others...great points...Thanks for sharing your thoughts. I am in similar boat as the OP. Its just that I already ventured out and now I am working as an independent contractor. I have a layer to go through between the Client and my employer (Desi).
Big consulting firms could charge 180, 200, even 250 to the client depending on the market rates for the particular skill set. Like most of you all mentioned, they do because like you, they want to make money as well. They have a bigger obligation of making their stakeholders happy. They do lot more than an average independent contractor do. They establish contacts mostly not at the middle manager level, but at the CEO level. As a CEO/CIO of Deloitte/IBM they have better access to CEO/CIO of the client. As it is pretty obvious, CEO/CIOs of the clients actually make/break decisions. So they are generally more successful getting big dollar projects. Once they secure a project, they obviously tend to place their employees on to the projects. Occasionally, they also hire sub-contractors AKA independent consultants when they don’t have enough internal resources.
I am looking for ways to be a successful independent contractor. I believe, networking and building a reliable set of people who can help you is very important. But the challenge is, it is not easy to find people who are reliable and who will ACTUALLY help you land a project. And of course it is not easy to stay in touch with everyone (at least for me).
To OP: I think you will have to decide what you want to do in your career. If company sponsored training, marketing, working on cross platforms/applications, stability, "company name on your resume", etc is important, you will have to compromise on the money. If you want to make quick money, take the plunge and jump in to independent consulting. You can potentially double your salary. You don’t have to have a G.C. to be a independent contractor. G.C./EAD certainly helps but not a requirement.Find a good desi employer who will support you and who will pay you "your share of money", find a good stable project and you are good to go. YOu can save money on taxes as well. But then the downside is, you pay for your own training, traveling and benefits.
End of the day - There are pros and cons on both sides of the world. Pick your choice, you will have to compromise on the cons.
BTW: I have to agree with Sanju on the commissions/under the table transactions that are reality in the consulting world.

actually, lets make another category 3.c. people who have shifted jobs after ead using AC21 and now want to or already have started a company for side business (that may be in the labor/perm cert job description or outside)...
So, I am 3.c. and so is perhaps matreen... after digesting my conversation with the lawyer for two three days now, i am feeling that it might be worth taking the risk of doing a side business. after all, we are not doing anything that is uncivil or criminal... just trying to boost our incomes and perhaps contribute to an industry or something like that... that noble intention could be viewed as an exclusive intention in relation to the intention to continue permanent employment with the new GC sponsoring employer... what do you guys think?

That's why we couldn't solve all the admin related issues then. If we had significant volume, we could have had visa re-stamping done in USA and the list goes on.. Any ways, I don't mean to give numbers.. But as long as we are on the same page that volume speaks and we don't have enough at this point of time, I am good.
We need a mass movement to make an impact. They need to get frustrated with the letters and will have to give a press statement that they are reviewing the matter. As long as we can do that. I think we can get DOJ attention. If 5K members send letters 10 times in 2 months, I have no issue, as long as we can annoy them with letters for justice..

yes, retrogression will remain the same for indians and chinese.....its already pretty bad for the indians. retrogression will hit ROW harder as they are current right now....atleast for EB2. let feb or march 2008 roll around then its going to get worse.

It's just applications moved from your home queue to the USCIS queue. Why would that make retrogression worse?? Think before you talk!!

i am getting frustrated to see the bulletin everymonth and it never moves.
people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.
dont know whom to blame. why cant they understand our problems.

Even my papers were filed on 2nd july before revision of VB. My questions:
Since VB is revised, my application would be rejected and sent back to Attorney's office. But when? How much time does it take USICS to send these application back?
What if it goes beyond October bulletin? If by chance (which I doubt), my dates become current then how would I be able to file my papers again, since medical reports are still with USICS, they had not returned it yet?
Any ideas?

I do have both Criminal attorney and Immigration attorney representing me, they say it should be fine. Again they say its upto the VO at POE. can I request the attorney to come to the airport during my POE time, so that i can request the VO to talk to my attorney?

I highly doubt that would be necessary. Just take an evaluation document from your immigration attorney as to why your conviction doesnot render you inadmissible.
Also when asked for explanation, give a honest and sincere explanation, showing remorse would help too.

I support this for point #6, to me if USCIS + DOS worked slow and wasted 200K visas then we shouldn't be paying price for that. They need to make it up and correct their mistake. Its not that hard but we need to raise voice, if the culture of this country suggests that we should go Lawsuit route then we should follow that route.
I think USCIS is also looking at closing loop holes, and to avoid a lawsuit that USCIS is purposely delaying GC and milking thru EAD/AP renewals they have changed to one-time fee structure. So we should hurry before they bring some kinda memo to block recapture route too.

You all are right that we should not divide ourselves on EB2 and EB3 basis. But it is true that there is no hope for EB3 unless the point is raised for it in IV drive. EB3 is a hopeless case. People are so frustated since they are unable to decide about their future. Let's do something for it too.

I140 has been approved
I485 application is 180 days old
You have no freaking idea what you are talking about. one should not open his/her mouth so confidently without reading documents from USCIS or talking to an immigration lawyer.
