Kaiser started this new rule to not hire folks on EADs as of last week.
I thought, this may be the work of various vendors who fear of losing lot of their employees jumping to the Client as Full time employees. Dont know actual reason yet.

Got RFE for Employer Letter, Missing Vaccination and G325. Replied on Apr 30, 2009

The last updated on my and wife's files were on 05/12/2009 (after the RFE Respnose)
I Went to the Local USCIS center on 08/02/2010. IO mentioned that Name check and FBI check had cleared. But he could not tell if my case was assigned to an IO. He asked me to open an SR. I called the 1-800 number and opened an SR on 08/03/10. I got a standard email from USCIS for the SR I opened, on 08/11/2010. It said that my case and my wife's were both were under review and it would take up to 60 days for them to process it.
On 08/13/2010 8.03 CST, I got a SMS on my cell that My case status was updated. I had received that Card Production was ordered on 08/12/2010.
Now, I am waiting on my wife's approval.

I guess the emails and updates are sent by some kind of batch processing system. I got the email at 5:15 am, do you think that uscis guys would work that early...., duh....
So cool down, you will get email soon.
If you are doubtful, call uscis one more time, and confirm that your case is approved.

Your response would depend on how badly you want this job.
Most times the hiring staff doesn't know the law and are too lazy. Anything out of the ordinary, they just reject.
If you want the job, you don't want to appear like a trouble maker. So, you could just write back politely that you were surprised by the disqualification since the Department of Homeland Security (do not write USCIS) had issued the EAD and enquire if they know that DHS guides employers against discrimination towards EAD holders. You can mention or attach form I-9.
Alternatively if you want to hold their feet to the fire, you can contact a lawyer. Hiring a lawyer should get their attention. Let the lawyer contact them. And also let DHS know about this employer. Write to them.
In any case, we cannot let employers come up with their own laws after we have gone through so much to get to the EAD stage. The law is the law and we are following it.

USCIS decided to take our $604 and give me an my wife APs in 9 days! They seem really efficient when they have to take money from us. But really slow when they have to approve GC applications (EB2, PD of Dec 2004). USCIS just seems to be interested in 'extortion' payments to employ USCIS staff - more a lawless mafia than a organization upholding the law!

Even USCIS has pre adjudicated all AOS cases , DOS will not be in good shape to predict perfect cutoff date ever. WHY ?? Every year in Sep DOS move dates forward in order to prevent visa waste. Lets say because of these pre adjudicated DOS knows that they are 10k pending app before Sep 2004 and supply is 7k. Still they will move date till 2004 Oct just to give room to USCIS. If they move date to July 2004 which has 7k app and supply is also 7k and some how USCIS has problem approving some cases because of some reason then they will waste few visas.
Till last year DOS was moving date randomly but this year they had move date with little offset. In Oct they moved date forward little bit because DOS think USCIS will not be ready with those left over case from 2004. If they will then they will chew Oct supply and 2005 Jan applicants will not get any visas. Again supply in Oct is only few hundreds visas to only lucky people from 2004 and 2005 will get green card. I am hoping DOS will do quarter spill over where we can get almost 10k Spill over and dates can move to Dec 2005.

My wife is on F1 visa and I am hoping the dates will move soon and we will be able to file 485. I would like to know if

Thinking differently isnt bad. It just came to my mind that this may also be tried.
I think we have proved something like this not very long back about 60-70 years back. We have set bonfires of all our imported clothes and said NO to anything made in Britain. Right. So what did we really mean. I am sure many brands we wear today are international too. Nothing wrong.
Why did somebody show the other side to be slapped, did he like to be slapped. Its to get the point across.
Its a way of protest, a peaceful way to get attention to a problem which must be fixed.
If most of you dont agree, then I may be wrong, lets see response.
But lets always maintain that they do care and its a two way requirement and not just ours. We may be desperate due to system failure, but they are too, else there wouldnt be an immigration program. Most countries dont have, if I am not wrong. Its different with US which is a big country and same is the case with Canada which is trying to build.They need people.

It is simply crazy of USCIS, but it is not beyond commonsense for us to realize that the notice was mailed in last few hours of the previous FY, so there might have been those hiccups between USCIS and DoS systems releasing the last few visa numbers.
Understand that you might well be current for this FY but the notice was generated in September. So now you should do your best to make sure your file is not relegated under a big heap somewhere... as others so rightly suggest, the congressperson route should serve well.
I recieved 2 notices in mail today.
One is the welcome notices which says that I-485 is approved.
Another notice which says that they reviewing or reconsidering the decision previously taken.
Called 1-800 # and the infopass. They say that reopened or reconsidering the case as the visa numbers retrogressed.
How can that be when am current in oct as well.
Mine is EB2 and the priority date is Dec 2004.
Any suggestions to have this fixed.

How long does it take to receive RFE letter by mail? Can we get a copy of RFE letter at the InfoPass appointment. I don't have patience anymore to wait. At least they can tell us what the RFE is about on the phone. These guys are trying my patience.

We all know that IV is not Indian. More Indian!=All Indian. Lets not worry about it and most importantly I request IV members from all countries to ignore it as a reporter mistake as they script stories in their fashion to elicit more coverage. Right but the here problem is that how to come up with written evidence of discrimination? These jerks do not send you an email "Hey, we do not consider EAD". Their pattern is generally as under.
I understand. For an analogy consider theft. You might not know who did it but you lodge a complaint with the police. Its their job to investigate. Sometimes they are successful, sometimes they are not.
In this case if the govt gets lot of complaints, and find a pattern they will investigate and find the dirt.
All I and a few others are saying, discriminating EADs is illegal, and there is a govt. agency to deal with these things. So, if anybody is a victim contact the govt. agency. By being quite we are not helping ourselves.
I understand. For an analogy consider theft. You might not know who did it but you lodge a complaint with the police. Its their job to investigate. Sometimes they are successful, sometimes they are not.
In this case if the govt gets lot of complaints, and find a pattern they will investigate and find the dirt.
