    The Department of State announced that the Indian EB2 category is expected to advance one week in the May Visa Bulletin. The demand for EB1visa numbers has decreased by 50 percent this fiscal year. Last year from October 2009 to February 2010, 22,000 EB1 numbers were used. During the same period this year, only 10,000 to 11,000 have been used. EB1 will be current worldwide all fiscal year. This will free up an estimated 12,000 visa numbers to fall down from EB1 to EB2 this year

    Yes I had one pending and no RFE was received for either. My lawyer is expecting a notification from USCIS stating the second one is withdrawn.

    congratulations! So you had the second I-485 still pending when teh first one got approved? Did you get any RFE about it from USCIS or were you asked to withdraw one of the petitions?

    I had my interview on Jan 14th for H1B extension..same company after 3 years..fortune 100 company..VO said approved..but i have not received my pp yet. Its the 18th day and in weeks this is the 3rd one.
    My brother also works for the same company same mgr..he also went on the same day for his stamping. His F1-H1. his VO was different..he got his pp after one week.

    Have there been people waiting more than three weeks ?? what is the worst wait time for someone here on the forum ??

    I have already postponed my flight twice..since i have to take my dad along..i have also postponed his flight twice..this was a family emergency travel and not a vacation..still its so painfull..and like everyday there is a wait..

    I don't understand where is the conflict here. The website above - ALIPAC - is "Americans for Legal Immigration". From what I read in their website, they want to stop illegal immigration and they support legal immigration. Unless they have a hidden agenda, they should be supporting IV's letter campaign.

    How is this in conflict? Am I missing something?

    I dont know too much about the conflict but the first post on the site says this:
    Immigration Voice is starting a massive campaign to make it easier for immigrants and those on non-immigrant visas (H-1Bs, L-1s, F-4 students) to get green cards --- furthering the displacement of skilled American workers (programmers, engineers, scientists, etc.)

    So, I'm passing along this suggestion from another group:
    Please read the email below, and I ask you to cut/paste their letter text, and then
    customize it (which is to say reverse engineer it) asking them to CLOSE
    the door, not open it wide. We must act NOW to counteract their
    campaign.

    Something is screwed up.....

    Mexico has over 2000 cases in April 2001 yet its PD is May 1st 2001
    India has less 500 cases in April 2001 yet its PD is Apr 15 2001
    This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.

    I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.

    For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.

    Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

    How will USCIS will know? They have all your immigration related documents including I-94. They can track all of your movements.

    If I am not wrong, buffering wud be to take in new 485 applications, process them and keep them ready.

    In that context, most of the applications till 07/07 have been preadjudicated, new buffer wud require dates to be pushed to 07/07 or later.

    If they add EB2ROW Fall across numbers(6-8k) from first 6 months it will be 20K towards EB2IC backlog. USCIS may need buffer since all pending cases are not pre-adjudicated and some cases will be denied.

    20k can clear all back log until 01-JAN if they need buffer they can move to 01-MAR-2007( 2 months or 5k) or 01-MAY -2007 (4 months or 10k), worst case can go to 01-AUG-2007(7 months or 15k)! my guesstimate.;)

    I have filed my green card with her. But in all our discussions she has sided with my company's interest over mine. In fact in one of our FYI meetings, she said that getting the green card faster would not be good for companies as people would quit after that. So I am not sure whether she will take up the cause but we can try.

    Would anyone be able to advise if I can travel out of the country after I've filed the 485 if I have an approved I-797 approval notice (for H-1B) but old H-1B stamp in pp has already expired?

    If I travel out and then get the H-1B visa stamp at an outside consulate, I would be able to travel back in, but would I have considered have abandoned the 485 application? (since I travelled out without a valid H-1B stamp in pp)??

    Can I travel out even before my AP arrives? Or does having an AP make a difference? I would prefer to stay on H-1B status since you never know what happens to the 140/485 application.

    I am in the same situation as yours. The visa stamp on my passport expired last year and I have an approved I-797, which is valid till Oct'07. I am planning to file for I-485 on June 1st and I want to travel to India as soon as I can. My attorney's advise was to wait for receipt of I-485 application and then travel to India and get H-1B stamped on my passport from a US consulate in India. According to him this is not considered as abandoning I-485.

    I have two approved I-140 (NIW/TSC 06/2006 and EB1A/NSC 07/2009) and a
    pending I-485/TSC from 2007. I went infopass two weeks ago, and was told
    that my I-485 was pre-adjudicated and assigned to IO on 08/2009. The
    infopass officer kindly sent an e-mail to my IO requesting for update.
    Yesterday, I received a letter saying "We are actively processing this case.
    However, we have to perform additional review on this case and this has
    caused a longer processing time. If you do not receive a decision or other
    notice of action from us within 6 months of this letter, please call
    customer service at the number provided below."

    Does anyone received a similar letter? Is it just some letter or some problem
    with my case. I have been in this country for 11 years, used up all 6 years
    of H1b, renewed EAD three times, and tried service request, called IO, wrote
    to Senators/first lady. Not sure what else I can do...

    I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.

    What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
    If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

    Amazed at the level of speculation, inspite of the detailed Procedures released by Rajiv Khanna ( and re posted by IV) .

    I am one without an EVL, sent after new memo took effect , that has been recipted and finger printed.

    So please read the 485 USCIS procedure again, and do not worry about sending endless 485s just because of lack of initial evidence




    I doubt that. Medical was relaxed since it can take time for people to get the medicals done. Also immigration doctors were all busy at this time. So it is possible that people arent able to get the meds done by the Aug 17 deadline. The other documents like EVL shouldnt take this long. If the employer is willing to provide future employment to someone then it should be sent along with the application. Whether USCIS will relax for lack of Initial Evidence other than Medical is hard to say. It is always better to be safe than sorry.

    Its been over 3 hours now that I informed CapitalOne that the discrimination is illegal. And as expected, no reply received yet.

    First of all, they cannot ask you for you work authorization during the interview process. Second, even during hiring time, they can only ask you if you need sponsorship for H1 or not. If at this point you say no, then they have no business asking you for what kind of work authorization you have (unless the job specifically asks for US citizen or security clearence).

    You should be able to forward the email to the local dept. of labor and also the Attorney General's office. What I don't understand is how TCS is in the picture. Is this a contract job that CapitalOne has outsourced to TCS? If it is, then they still cannot deny you a job because you have EAD. That is clearly discriminatory. All you have to do is show the I-9 form.

    If I were you, I would forward the email to the State Attorney General's office and also to the local DOJ.

    I think it would be fair to split the leftover numbers the same way they split whole year quota.

    50% of leftover should be given to EB2 (based on PD) and 50% of leftover should be given to EB3. Does it sound fair?

    Good news... I got CPO at 9:05AM.

    I raised SR for my case on 9/2 and no response until today morning and raised SR for my wife yesterday night. No changes to my wife application.

    I asked my attorney sending an e-mail for TSC streamline process and I do not know whether he acted on it or not.

    Good luck every one who are waiting for approval

    Dont wait too long.. Just keep going.. No waiting..
    Imagine you are waiting for a bus.. that would not come.. then what do you do.. keep walking towards your destination.. And if there are others who want to come along with you in your safar, then it makes it more pleasant and less painful.. You all have contributed with your ideas.. Spread them and keep going..
    Now I am going home.. Will send this letter to other sources also.. i will get some more contact info tomorrow.. But Always write to change.gov. No president in the past has created such an option in the past to hear us.. Don't overlook it. I made small changes in my original letter. So in case anyone copied it before 5 min, you want to take the current one..

    I heard that we have to provide all the address where we stayed in USA for filing I485. But very first time I came to USA almost 6-7 years back for short term and I do not remeber the actual address. Basically i do not remeber very first two address when I came here for short term. Is it a matter of concern.

    It could also be that they are confusing your EAD with EADs used mostly by students on OPT which leads to H1B to Greencard sponsorship.

    I am planning to go to india in July. After seeing all your posts i am thinking of getting stamped in canada.
    Any idea how long it takes to get back the PP in canada?
