Hope everything will turn out good for you. I don't know faith of our applications.
I�m July 2nd filer application reached to NSC at 9.1 am and signed by R Mickle
Till date my checks have not been cashed. When I Called service center yesterday they gave me Receipt Number for I-485 (LINXXXXXX) but again she told me that�s its Invalid then she put me on hold and checked something then see verified my address, Social security number also My Attorney�s Name and address. After confirming this information she told me Receipt Number of I-485 is yours but its Void in our system let me check it online and online it shows case received and pending.
Now she said its weird its showing Valid in online system and in our internal system its Invalid. Then she asked me did you file 131 and 765 along with this I said yes then she said let me check it and found nothing.
She has created one service request for me and asked me to wait another 45 days.
Meanwhile I told this matter to my Attorney and he told me not getting receipt is normal and I could have asked you to wait till October 15�th but you are there in the system and why they have stopped processing you applications looks strange to me also applications is not been rejected. So he told me that he will write letter to USCIS director to investigate this issue and assured me that as long as we are in their system so don�t have to worry but he told me that if Director don�t respond in one month�s time then we will go to court but he is optimistic that situation may not go to that.
If anyone of you in similar situation please let me know.

I believe that we will get 14-15K from EB2 ROW, EB1 = 12K (currently) + 6K (Minimum), regular cap I/C 6K. Eb2 row usage is down to 60%.
Total Numbers = 14 + 18 + 6 = 38K.
Now total demand is not just 34K demand data we also have porting and new filings especially from May - Jul 2007. My assumption of porting has been 6K out of which 2K have been approved.
So really its almost an exact match till Jul - Aug 2007. We should wait for the May bulletin thing to come true firts I believe VDLRAO gave a great calculation for that.
Don't forget EB5

My company applied 100 485's . 85 from NSC and 15 from TSC (140 aproval). All NSC people got receipts, some of got FP's also. But TSC people still waiting for checks to be cleared.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

This trend chart/volume chart certainly represents both family and employment base applications. Following is my thought process now with keeping both trend chart and teh worksheet in this thread chain together.
(1) In Worksheet USCIS claims total EB pending case 233816 by December 2009. Yet we
have not reached to December 2009. Trend chart claims total pending 279031
including family base applications. Since famaily to EB ratio is unknown I would
consider worksheet's figure as authentic for pending EB based 485 cases. One practical
clue for inclining to do this as I know USCIS has approved tons of green card in
parental family category. Many of my friends have got GCs for their parents in a
relatively very small time frame - 1 year
(2) I remember somehow that out of 775000 485 applications in October 2007, there were
around 300000 application were from EB category based on USCIS's published
notification ( I tried to find it on internet but some how I do not see it now). If
somebody has a more solid proof this stats from which we can derive nearly accurate
ratio we may consider those stats. But as I mentioned in point 1 USCIS seems to have
cleared more family bassed 485 with comparison to EB categories I would just
assume for now that 60% preadjudicated cases and "awaiting customer action"
and "New receipts" are from family category and 40 % are from EB category. Total
preadjudicated cases per trend chart is 178418. 40% of that around 71367 - for the
sake of easiness let's make it 71500. This way "awaiting cutomer action" cases for EB
categories could be around 18-19000. "New receipt" cases could be around 18000
roughly.
3) Now total EB based 485 cases by July 2009 could be = Pending cases + preadjudicated
cases + cases awaiting customer action + new receipts = 233816 + 71500 + 18000 +
18000 = 341316. Just the sake for simplicity in assumption we may consider total EB
based 485 workload with USCIS around 350000.
4) "In general" the first lot who will come out from this gutter is "preadjudicated" then the
lot "awaiting customer action" then the "pending ones" and then " new receipts"
Now based on my talk with USCIS guy I can state that USCIS generated RFEs innear past for many cases as apart of preadjudication process, particualrly for may AAC21 usage related cases - Asking for proof of employment in the same job classification. According to that talk if USCIS gets required response to the RFE then USCIS settle that case in a "preadjudicated" shelf. In other words the AC21 guys who got the RFE - responded and case is resumed - most of them should be on "preadjudicted" shelf. If we call USCIS generally let us know that whether our particualr case is preadjudicted or not.Lucky one may get that reply in first call and somebody may have to try calling multiple times.

It happens to me too. Anything too good has always followed by something bad and vice-versa. I am just talking about the pattern. When my LC got approved, my spouse was severly ill and diagnozed with severe un-curable heart condition and is under expensive & tedious treatments now. We have to confront life as it comes and avoid making any hasty decisions based on the situation. That's the main reason, I am desparately waiting for GC, so that we could get better treatments, which I cannot even imagine to get in India.
Anyhow, here is the letter I have drafted to Napolitino. However I would like to stress the point that USCIS has to approve the applications based on PD, but lost for words. (Thanks SoP for your idea of first few sentences in this letter)

Yesterday was a very eventful day for me...in the afternoon my wife got approved and 12 hours later we had to call in emergency 911 to take her to the hospital as she was having such strong chills and violent shakings..we all got scared and we have a 2 and half month baby on top of that.....but with strong dose of antibiotics and drips she is better and back.....wow what a day and night.....
In any case I'll answer all your queries....I feel the option 4 is the best way to get to TSC...I have always used that....congressman's office has discretionary powers and you should use that.....use strong words it is your right......they are here to serve you unlike in India where they are there to get pocket your money....no pun for my motherland but unfortunately it is true....
Try a time frame of 4:30-5:30 EST to call the TSC or NSC for that matter...ppl are in a better mood at the end of the day and on thursdays and fridays.....ping your lawyer and ask him or her to intervene......if you know for sure your case is preadjudicated write it strongly in your mails to DHS and others.
I had in fact attached the previous year letters and their responses back to me in my last mail to Napolitano and it was really quite strong.....I am sure it is hard not to take a note of it......I don't mince words and I believe that one should fight for one's rights....
I have been associated with organizations like ASHA, AID and DISHA for long and that have taught me a lot too.............
Again your attitude should be "You have nothing to loose"...so make a best case for yourself and go for it...

EB-2 or EB-3 is not our birthright. It's just a matter of circumstance that many of us found ourselves in one category or other. It does not even necessarily mean any difference in skill or experience. There are many people in EB3 with Masters degrees and many people with over 10 yrs experience.
Dude everybody wants their GC. If you want to fight injustice fight for something positive. You will only get bad Karma by undercutting other people :mad:

Today I have frank and candid talk with senator office staff. This time I put FIFO question in forefornt (becoz I know what she will hear from USCIS). She promised to raise the issue with USCIS senior staff. She requested to give my concern in writing again. Let's see if she makes any difference.
Two issues raised with her in writing:
1. My I-485 Adjustment Application was delivered and physically received to INS Express, Nebraska Service Center, Lincoln, NE on July 2nd 2007 @ 11:11 AM via USPS Express Mail (Tracking No. EXXXXXXXUS). It’s approx 90 days. I didn’t even receive the Receipt Notice from NSC. Please help me track the fate of my application.
2. USCIS follows standard practice of First In First Out (FIFO) process. USCIS website reports issuing Receipt Notice for I-485 application received on August 2007. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? NSC have to work first on receipting and subsequent process of July 2nd application before NSC start working on July 3rd to August 17th Application. It’s unfair to applicant like me. I want honorable senator ask USCIS Management basic question, Why FIFO process is not followed?

Two issues raised with her in writing:
1. My I-485 Adjustment Application was delivered and physically received to INS Express, Nebraska Service Center, Lincoln, NE on July 2nd 2007 @ 11:11 AM via USPS Express Mail (Tracking No. EXXXXXXXUS). It’s approx 90 days. I didn’t even receive the Receipt Notice from NSC. Please help me track the fate of my application.
2. USCIS follows standard practice of First In First Out (FIFO) process. USCIS website reports issuing Receipt Notice for I-485 application received on August 2007. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? NSC have to work first on receipting and subsequent process of July 2nd application before NSC start working on July 3rd to August 17th Application. It’s unfair to applicant like me. I want honorable senator ask USCIS Management basic question, Why FIFO process is not followed?

Its not true, plenty of non-white countries do not require a visa unlike India which has the worst visa policies in the world. Obviously most countries require a visa from Indians because India does the same needlessly. Its time the Indian govt revisited these primitive and ill conceived rules.

I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. .

The case was brought against iGate Mastech for placing an ad for 30 programmers between May and June 2006 "that expressly favored H-1B visa holders to the exclusion of US citizens, lawful permanent citizens and other legal US workers" according to the US Department of Justice.
So-called citizenship status discrimination is prohibited by the US Immigration and Nationality Act. The DoJ said it is "committed to protection the right of all authorized workers in the United States against citizenship status discrimination".
Get your facts right before posting. mastech is not the only firm that did it. As you pointed out, many of these fly-by-night operators (and bigger outsourcing companies) offer below market salaries, pocketing the difference like parasites.

There is nothing wrong in fighting. At least it will be used to prevent the same mistake in future. But it is not a bad idea to analyse the outcome so that everyone can prepare for that. My view is this campaign will be used for preventing future mistakes. I will be pleasantly surprised if we get more benefit than that. Even lawsuit also will serve the purpose and will give strong warning to USCIS.
I can tell many examples. Due to one persons misjudgment so many American and Iraq people were killed. Do you think they can get relief? Whatever relief people got it cannot bring back peoples lives. But still lot of people are thinking that Iraq could have been handled differently and many people are fighting against War. Most people realize mistakes after someone is impacted.
You seem to be pretty good at analyzing faults in others' ideas and thoughts . What are your suggestions to acheive releif from retrogression.
