How can we get this issue more visible to IV members? Just 64 letter is not enough. We are a community of 30K strong!!!

Please start ending letters, ask/encourage your peers to send them as well.
Looks like most of IV members are being ignorant of these issue, this will be a big issue if not acted fast. We need to get it corrected before it becomes a major one. Look at DOL's unemployment figures 6.5% unemployment was announced!!!! Worst since 1994.
Please act on these.

Dear Smisachu/ and others:
I was also planning to go to Kolkata this summer to extend my H1B for another 3 years. Now, I am so scared reading all about the PIMS verification; delay of issuing visas; and returning passports. I am also sacred because I did not apply for any AP because at the time of applying for my 485 my H1B was valid (in fact it is valid till July 08).
So, what would you guys advise me to do:
(1) Go to Kolkata (with my 485 receipt notice, original) and return before my
current H1B expires in July 08? Or, (2) apply for an AP (it is my understanding that AP is rejected by USCIS if someone has a valid H1B)? Please advise. Thanks.
this is my thinking... number of cases which are getting delays due to this PIMS check should be considerably less when we calculate in terms of percentage... all the persons who are getting passport quickly may not be coming to these forums as they will be busy in their India trip (though there are few people who posted and I salute them). And I guess whose passport get delayed .. most of those must be coming to such forums... so in terms of percentage it might be 10% or less of cases.. so if we decide to go for stamping, there will be risk of passport delay but the probability will be less...
these are just my thoughts.. no other source of information.

People who have written letters themselves, post the Letters here. I am having 7-10 ppl in my office write the letters. It will be good if u guys can post the letter contents. I can simply have them write and sign with different letters. People are lazy dont wanna think and write.

Hi,
One of my friend is working in L1 on Informatica tool for one of the financial client.
Does it mean that his company is violationg rules?
His company is harrassing much for some personal reason and asking him to come back home country
what action he can take against his company if his company viaolating L1 rules.
Please anyone come across this situation then give us your suggestion.

He can not take any action. If they ask him to go back he has to go back. If informatica is embedded in another s/w which is company copyright then there is no technical violation of L1. Also if the project is administered by his company there is no violation of L1. If it is staff augmentation case, which does not seem to be the case here, then it could be violation of l1.

My husband's EB2 Dec 2003 I-485 is at NSC and has been pending. Called customer service using POJ method and got an answer that the application is assigned to IO.
We have replied to RFE two months ago.
Can anyone guess how long it usually takes for IO to actually look at it and approve.
Does it help to file DHS form 7001 or contacting congressman at this point.

Thank you for the reply.
I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?
Response that I received for the above email:
Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.
The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.
If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.
If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.

I called them. The rep was aware of the Vonage deal and offered only $ 4 rental and 2.9 cent per min to india. So I am also thinking to move to vonage.
I just talked to them. Rep said they can not match vonage offer.... I am already paying teleblend around $16 per month. I see no reason why I should not pay $9 more to Vonage in order to get Unlimited India Calling plan. (As I also spend atlest $20 - 25 on reliance india call additonally.)

Why do we need 325A?- i thought this was for people in illegal status. Our son entered the US on valid H4 visa. Also do we need to request in application to attach the file to mother or anything like that. I will give the USCIS a call and share that information here if I find anything more.

I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
I know many 2nd July filers who have even received EADs.
I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....

Our friend Smitha doesn't understand the Problem at all.
I'm in this country since JAN 2000 but my actual Labor was filed in MAR 2005 because my 1st company SOLD my 1st labor ...... Its a PAIN you know - cycle of LC , 140, 485... Like cycle of birth and death...
Moreover Smitha is talking as if whoever "sent flower"/"stood in rally" made an assumption that a GREEN colored plastic card will be handed over straight off the Grill instantly !!!!!!
Come On - No one here is a bull head. Everyone knows Visa bulletin will not change much before 2008 but we want to send the message across that we WOULD NOT TOLERATE INJUSTICE AND HARASSMENT SILENTLY.

There are several people who has to re-file their labor for several reasons (employer greedy, company overtaken, laid-off, company gone bankrupt etc etc.). That does not mean that 2005-2006-2007 guys are asking that they should get GC before 2001-2004 people. What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.
I'm sure if you widen your horizon, you will be able to understand the plight of all your brothers and sisters stuck in this retrogression.

I am looking for a Project Manager in a Tri-state area, who is extremely Hands-on with CRM and ERP Technologies. At least 3 years of experience with CRM & ERPs. Has to be able to communicate well, excellent verbal & written skills.
Knowledge of Infopath and Sharepoint is a HUGE PLUS!!! As well as any Accounting experience.
Must have a valid American Passport or American Green card!
( unfortunately on this position we cannot work with H1B or Third parties, or any other visa-status )

At present my EAD is status not changed (USCIS case tracking), So I assume my EAD is valid. I also read Attorny Ron's blog that EAD is valid even I485 is denied. That gives me some comfort. Another problem, even if I get H1b (with out I94), I don't have AP to go (out of country) for stamping. What happens if I apply for AP while I485 is denied? Any one tried this? I am not sure what to do...
