Free calls to India!! Awesome! Thanks for posting this here. 11 years ago, it used to cost $1.05 (using ATT) on weekdays and $.65 over weekends to call India. I was studying and my phone bills used to be more than rent! :).
I have been a Vonage customer for last 2.5 years and it works great. I use it for US, UK, Singapore calls. I use Airtel for India calls. From now on, it will be Vonage for India calls and Airtel if I need to call from my cell phone.

I am really surprised by the meek response...what is wrong with everyone?? We have just abt 54 letters so far and almost 200 members online right now !!!
If you are reading this but have not written a letter yet, please answer one question for me:
What is the least effort that you can put towards your immigration?
If you cannot write or type a letter, i'm afraid you don't belong to the "Hard working, highly skilled" immigrants that is being referred to in the letter.
Please send me a Private message with your name and deatils and I can write up and post a letter for you....its is actually going to be for me as I am benefitting from this campaign...i don't mind if you get the benefits in the process.
I have the capacity for 3 hand written letters per day...and I am dead serious. We need numbers and a meagre 100 letters are going to get lost amongst thousands of letters that are received at Whitehouse everyday.
People got used to Drive through mentality.

I called two congressman and in the process of calling others.
Had my relatives call 3 different senators as they are citizens and belong to the constituency. We can do it people.

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. The following information is asked in the first field of ETA form 9089.
"1. Are you seeking to utilize the filing date for a previously submitted application for Alien Employemnt Certification (ETA 750)?"
"1-A. If Yes, enter the previous filing date"
"2-A. "Indicate the previous SWA or local offiice case number OR, if not available, specify the state where case was originally filed:"
The reason for that question in the form 9089 was to give an opportunity to convert the old labor applications rotting in the Backlog Elimination Centers to PERM, when PERM was first introduced in Mar '05. AFAIK, this has got nothing to do with porting the PD. PD porting can be requested while filing the second I-140 after the new EB-2 perm labor has been approved. You don't have to disclose anything while in PERM phase.

Now as per my lawyer's advice probably we will need to change her status back to H4.
Do you know how much time it will take to get that status change? What if your PD is no longer current?

The interpretation of the intent of the law by USCIS is flawed and should be reconsidered given the enormous backlogs in various categories.
1. If the people are allowed to move between the categories it will just move the backlog from one line to another penalizing the ones already in that line.
2. It does not provides an equal opportunity to the people already in that line to move to other category who are patiently waiting for their turn.
3. The porting is subject to gaming and the people who know how to work the system will be the most benefitted by this.
4. It will also eleminate any potential for the spill of visa numbers from Eb2 to Eb3 category as Eb2 itself will be backlogged
It should be noted that the immigration benefits are associated with a job requirements and not a person's qualifications. Changing a GC category should not be allowed except in certain extraordinary circumstances and through appropriate changes in the law.
Mpadap, your arguments are valid but not pertinent to what I am trying to do. If a person becomes elligible , he/she must be allowed to apply for the positions matching his qualifications. Only thing is that he should not benefit from the portability of PD.
U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.
U'r logic should be similar to the below scenario..
A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.
Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

Rather than focusing on divisive efforts why can't you focus on real problem - retrogression. Why don't you work towards IV's goals? You folks joined the forum few months back and have already made great impact. Hope you would channel U'r energy into something positive for the entire community.

After all my research the bottom line personal opinion is: If you file multiple I485s, you should expect delays. Sometimes it can be a lot more than you can imagine if you get multiple A#s, file gets transferred in different service centers, you try to do interfiling between applications etc etc. Basically the more complicated you try to make your case, the more difficulty you may face trying to find out it status and adjudication.
Many lawyers strongly recommend against filing multiple applications and that is for a reason. Multiple applications is also an additional expense. You need to weigh the pros and cons and do what suits you best.

I don't have H1 backup and already in 8th year. I am on self employment, But my lawyer suggested to apply H1extension (through my company) as a backup if MTR denied. If MTR are successful they I don't have to go on through H1 hassle again..
The glitch is - once you have started using EAD and you apply for h1 - you have to get it stamped before you can use it ie your h1 approval comes without a i 94 extension - the costs towards going out - getting visa appointment , stamping etc.... are to be considered, and remember stamping in Canada and Mexico is not easy these days.

I am very sorry to hear this. It should be a rare case that you have got 221g after your visa has been approved by visa officer.
Approach the consulate with your email, and they might give you a questionnaire to fill up. It must be regarding some additional documents being required.

Everyone seems to indicate that the checks for fees payment to the INS need to be made out to USCIS, however, all the forms that I've downloaded from their website instruct that the payments be made out to Department of Homeland Security - which one is correct?

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the Colorado Congressmen Ed Perlmutter. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

I also thought of writing the letter in my own hand writing. I guess they WILL read it then. But my writing is so bad, it might have had an adverse effect..:D
