It is created to sharing ideas among members - to resolve immigration matters - not to discuss other topics like real estate investments etc. It is okay to quote one's or someone else's progress in financial matters in the context of his/her immigration status, but to make a complete turn and just discuss the specifics of financial investments etc. doesn't have a place on this forum.

My question involves employment and labor law for the state of: CA
I have worked with a company on h1b from 1st jul to 12 nov in 2007 on h1b visa. They did not pay me for last 45 working days. My employer is telling about the following clause in in my offer letter:
SALARY: You will be paid an amount equal to a 70% basis of your bill rate based on the understanding that you will work with us for a period of at least one year. If you leave Company before completing 1 year of employment your compensation will be adjusted to a $55,000 per year basis and the excess amount paid to you will be deducted from the last two months of your salary.
Please let me know whether this is legal to have this kinda clause in offer letter. Is there any way to get my salary?

CA Law very clearly states all employee dues including vacation payouts will have to be cleared within 72 hours of the employees last day. Unless you have signed any agreement to withhold your salary, your employer has no right to withhold the amount.
Even if you signed such an agreement and they withheld a penny more, feel free to call the DoL and your ex-employer will become an ex-employer

What state are you living??
I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.

Think twice before you post something on the forum, IV is a volunteer organization and core members are spending their valuable time to do something good for all of us.
If you think items need to be prioritized, share your thoughts, work with core team, post some analysis which makes sense, etc.

If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....

Guys ... first of all thanks for starting this thread. Worth every bit of space on server.
I am based in Michigan and would like to get in touch with someone locally to guide me in setting up a LLC. Well saying that, I don't mind venturing with like minded people outside MI too. I have few ideas and would like to work on those, these are in products and industry I am working with (Mechanical/ Industrial). However, I think same approach can be used to generate IP in other fields too. So i am open to collaborate with like minded people to benefit from each other. i emphasize on like minded people, because their would be failures too and so need equal buy in.
Neverhteless, what I am saying is if their is an opportunity to collaborate to succeed collectively? Write me back what you think and good Luck.

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.

Is the following (or can it be) a part of the Admin Fix Initiative? :-
Allow I-485 filing and/or obtaining EAD,AP benefits when I-140 is approved irrespective of priority date being current. This will help many of us who missed the July 07 boat.
After listening to his crystal cut views about fixing broken immigration system, my confidence level is boosted and felt like Dr.Obama has guts to deal this challenging CIR initiative for the better future of immigrants and for families of all of those hardworking smart legal immigrants who have been waiting for approvals from past 10 years. Hope it's not alluring speech for his upcoming elections. Problem clearly persists with politicians who don't like our EB VISA applicant community.
I think these following things should be the high priority items for IV core team and to all of us. People who have been patiently waiting to file for 485 since JULY 2007 are loosing hopes based on ongoing immigration trends. I think that it would take at least another 2 or 3 years to pass the CIR and to see it's law in action if GOP fellas have guts and to let this pass it successfully. I think that we should focus on two things to minimize the damage to our personal and professional lives.
I think one quick solution for fixing the issue of century old broken immigration system of USCIS is by allowing disciplined and long waited legal immigrant applicant to file for 485 application once his/her (I-140) application is approved. (Technically, I-140 is the real application for employment based green card. It makes sense for allowing applicant to file for AOS application (I-485 for personal information). this is justifiable with the current USCIS practice as USCIS doesn't approve his/her green card even if his/her PD ( Priority Date) is current unless they have visas to allocate for the case, so it should make prefect sense for 140 approved applicants to allow them to file for I-485)
Another thing is about huge EB backlogs for this broken system , that can be fixed temporarily by supporting and passing the recapture bill which allocates visas of those unused and wasted around 400K immigrant visas of last several years..

Not to offend anybody. but if you take a look at the sample of this thread as you can see the topic of discussion has moved from an action item to statistics estimate.
I admire IV and all its administrators, because grassroots efforts are never easy. IV along with its admins, has definitely had done a lot of hard work to reach to this stage.
At the same time, I would appreciate all senior members, and whoever reading this to keep the discussions more as a follow-up on action items.
Irrespective of statistics and the decision-makings of USCIS, it is very evident that some form of law changes must occur to clean-up this GC process.
As step 1 is bring an awareness among senators/congressmen and including the president that there is a problem that exists. I think this must be the only focus now to bring the problem in front with all the other problems that exist right now in front of the american politicians.

most of you seem to presume spillover from future years flowing to India- is that guaranteed? how abt a surge of armenians or bangladeshis using up row #s, which I presume at some point will start moving and head toward C much much faster than India..we're all basically screwed & will be responding to rfe's on retirement day which will be truly sad if/when we have same/similar job then....
