Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!
Thanks anyway for that answer. My situation is different beacuse with the I-140 PP going away for now...and my H1B expiring Feb 2008...I am left with approved I-140,Labor and retrogressed dates to be eligible for 3yr extension.
Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
You can extend your H-1B. Why is EAD your only option?

Agreed the statement "Indian Americans are brilliant" is too much generalisation, but Many of the immigrants from India and China are here because they are highly educated, so they put a lot of emphasis on academics, as a sports star might on his/her children in sports, likewise a movie star.
Its better to be guided by aspirations than to be misguided by carelessness.
This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.

Just different terminology, they do the prayer of nature (for some its God) and they never judge the acts of nature (God).

I just want to point out one missing thing here. I read all postings here and you guys talking about "People like lallu, Jaya, Karunanidhi, Naidu etc,". Might be you will add some more names for this category. I am sure most of the above patriotic Indians will not like to add names like Bal Thackeray, Modi etc. Majority of you guys like to add names like Dawood ibrahim (I hate guys who kill other human being including this guy) to bad guys list. At least people like "lallu, Jaya, Karunanidhi, Naidu etc" are Ok (that does not mean they are good). They kill one or two (might be 10/50) for their self interest and money. Guys like Bal Thackeray, Modi killing entire community openly by taking Police support. Same time so called patriotic-Indians elect these guys and make chief ministers. I always wonder when Thackeray, Modi can become ministers after committing such atrocities and walk freely in India, why can't people like Dawood Ibrahim (after all he is also indian and successful in his own profession).

See for your self what Pre-Adjudication means. Its literally conditional approval......
Pre-Adjudication is just a work flow method and not a policy. There is a high chance that a pre-adjudicated case may just get an approval when the visa numbers are available. But, who knows, they may have reasons to still issue an RFE requesting employment verification based on certain triggers such as change of address, over a year since case was pre-adjudicated etc.
So we may not be able to say for certain that all Pre-adjudicated cases will be approved when visa numbers are available.

This is not even good for long term due to hefty financial charges of insurance companies, you would not know about this until you buy one ,my sincere advice would be do not even get into this crap in US. these guys rip you off.
As I mentioned before Prudential charged 70% premiums as a finance charge every month and only 30% went to savings. It would never make sense and do n't listen to people who never owned these products before.

Thanks ilikekilo for the information. My husband medical coverage will start on the same day of his joining date. There is no waiting period. We need to find out what kind of healthcare plan they are providing and check whether my hospital and OB is under there network.

I requested IV to help us on this just like how IV did for the EAD cause. We all appreciate how much IV has done for us and helped in getting EAD renewed on time for so many people, may be this is something that they can take up. Here is Pappu's response for my request..

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.
I would only say "Hang On", or move on if you can. A lot of people in same situations, never want to discuss issues openly.
Patience does help, and maybe all the good is stored for future.
Most important is how you deal with stress associated with racial slurs, difference in treatment, and all the above issues. This has direct impact on health and many people in these conditions are victims of stress.

Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.
Which will be the good option for me in this situation H1 transfer or EAD? I have EAD in hand, but never used. I like to maintain the status of H1-B as long as time permits. My husband is going to get health information next week once he joined in the job.

Yes the service center will send your employer a curtesy copy and attorney the origial approval. Once you get the Feel bill letter and send the cachiers check, they will create a case and send the packet 3. in which you can find the NVC case number.

I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport. Hello,
With me having a pd even prior to of Mar 2002-EB3I, I thought I will join hands with IV to make something happen. To the extent I went and joined the IV chapter too.
Unfortunately, starting with the forum to most of the news that is being discussed seems to be not related to immigration at all. Example, accidents, investments, real estate. I feel the admin should be able to control and strictly adhere to what ImmigrationVoice stands for and delete any other unrelated threads.
Anyway, long story short, I feel IV has lost its focus and feels like for people who are looking at a proper approach to resolving problems, the web site does not give any reason or confidence, to follow or join hands for IV activities.
Just my opinion. Feel free to agree to disagree whoever would like to.
Not trying to blame anybody here, but sharing a viewpoint. In my opinion IV was great sometime back, but feel now there is a lack of direction.
I understand there could be lot of negative & positive comments about my reply here or me joining activities etc or not joining IV initiatives etc. I will explain my stance on those later.

1) USCIS still has not entered all the july and aug. filers. USCIS will have a good idea by Oct or Nov. how many applications are in the pipeline, how many they can approve and what the PD cut off date needs to be?
You are just repeating yourself. Show me the logic why entering all apps will retrogress the PD?
Let me give a concrete example. For India EB2, why would the PD not move from, say, April 2004 to January 2005, even if, say, 20 million people with priority date at 2006 apply for I485?
Understand the procedure first. With a better idea of applications in pipeline, you will see the PD movement to be better predicted, not retrogression.
