Hello all
I am a silent visitor of this website.
Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.
Also India is the great. Why don't you guys just think that India is your home country where you are born and brought up. Why you people can't just wait and watch?? If nothing happens to the so called GC, then why don't you think to pack up and go back to India???????
My sincere request, please don't do rally, you might be arrested......you never know what they can do..... Don't you think that, it is better to go back to India rather than being embarrassed here in US???

Just think that you will get it when time comes, otherwise pack up.

I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D

I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.

If the post is true and from real world person, then the OP and his sponsor are in violation of the Law. The L1B are not supposed to be based/hosted in client location unless specifically stated in the approved petition. Defiantly not supposed to do in case of blanket L1B.

Per discussions with immi attorneys, AC21 portability is not explicit on what needs to be done if I140 is substituted by previous employer and NOT REVOKED, and the applicant is eligible for changing jobs (same desc and 180 days pending). The fact is that this loophole leads to illogical scenario--2 applicants taking benefit from same I140.

On another front, if this actually does happen, I will be the first person to sue USCIS for all the expenses, lost time and headaches that I incurred in preparing the 485 application...I think USCIS can't get away without reimbursing everyone for all of the above...

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)
reminds me a famous quote about , some one who can't climb to the roof aiming for moon. (I sound pessimistic, but I am damn deserved to be one :)

My EAD expires today, I applied for the renewal on April 6th. This is my 4th EAD and I totally missed to apply in time this time.
1)Is there any way to speed up the process to get the EAD soon?
2) I cannot work from next week is there any way I can get through this ?

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Come on Mr. Dobbs, show some character. Don�t just make publicity stances. Change America and provide equal opportunity for all. As a first step just become a mentor of Big Bother & Big Sister organization ( it won�t cost you a penny) and motivate a high school drop out (you may pick up a white kid because everybody knows you do not like other color) to go back to school. Present him on your show and make him as an example of how America is changing to face the challenges of globalization. The Americans are eager to see some character here. Teddy, based on what we know now especially the past few days, can you give your average, best, and worst case estimate for September 2011. Same for rodnyb and GCwait2007. Thanks!
Also importantly, if you could comment on the PD for EB3-I/C and EB-2 I/C in October 2011 once this year is over. Will we see it retrogress or current and what's your average case for the dates then.

Hi,
We have already made plans for our India trip. We will be leaving US on June 2nd. Can we apply 485 on June 1st and leave to India on June 2nd.
Will there be any complications around this.
As we will be returning in July, we are not sure if my PD will still be current by the time we return back.

If you want to know what's really wrong with our immigration system, consider the July debacle at the Citizen and Immigration Service.
Individuals and businesses typically have to wait years to apply for "green cards" for permanent residency based on job skills. The backlogs have been so severe that an engineer from India or China has had to wait six years to apply for a green card. In other employment categories, the wait can be nine to 11 years. For people from the Philippines, the wait in some work categories is 22 years.
But then in the monthly Visa Bulletin issued June 13, the State Department said that employment-based visas would be available.
This set off a rush among sponsoring businesses and individuals who have waited in line for years to apply for green cards. Thousands prepared applications and mailed them in time for the immigration service to receive them by July 2, the first day of the application window.
Then on that very day, the State Department issued a "never mind" update, announcing that the 60,000 green cards it had expected to offer would no longer be available. The thousands who submitted applications will have their applications sent back to them.
As Los Angeles immigration attorney Carl Shusterman said last Tuesday, "We're right back to square one, with scientists, engineers, teachers and health care workers having to wait in endless lines for employment-based visas."
Rep. Zoe Lofgren, D-San Jose, chairwoman of the House Judiciary Subcommittee on Immigration, Citizenship, Refugees, Border Security and International Law sent irate letters to the Secretary of State and Secretary of Homeland Security. She said that changing course midmonth is contrary to years of practice, would result in the loss of thousands of dollars already expended by sponsoring businesses and individuals to prepare applications and, more important, would "threaten the integrity and predictability of our immigration system."
This is no way to treat people who try to play by the rules.
The Citizenship and Immigration Services Ombudsman notes in his 2007 annual report to Congress that the nation has a "perpetual backlog" of employment-based green card applications. This backlog means that even green cards that should be available aren't used. This contributes to the backlog; if green cards are not issued in the year they are authorized, they are lost.
In 2006, more than 10,000 employment-based green cards were lost, even though the immigration service had 100,000 to 150,000 applications waiting to be processed. Since 1994, nearly 219,000 employment-based green cards have been lost because the immigration service isn't processing enough applications in a timely manner.
It gets worse. The funds appropriated by Congress to jumpstart a backlog elimination project expired Sept. 30. The backlog will continue.
In the long term, this country needs to increase the number of employment-based green cards to meet demand. But if the immigration service cannot even process applications in a timely fashion for the current numbers of employment-based green cards that are supposed to be available, what's the point?
In the short term, if Congress and the president do nothing else regarding immigration reform, they should at least make sure that the immigration service processes green card applications in timely fashion. The backlog is inexcusable and contributes to the nation's illegal immigration problem. If we want people to play by the rules, we have to make it possible for them to do so.

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)
reminds me a famous quote about , some one who can't climb to the roof aiming for moon. (I sound pessimistic, but I am damn deserved to be one :)

Do we also have to include thepage of the DOL labor certification showing the priority date (if labor certification is required) ?

Pappu, what do you mean by "this may have delayed your greencard since July"? What is his mistake? I too have been trying all means since mid Aug. Is there something wrong with that?
Let me give you an example and you would understand my point. USCIS Customer Services Directorate received 16 million calls from the public and 300,000 from Members of Congress. Add to it, all other items people do to get attention for their case and think that by sending an email or a phone call from Senator or by a lawyer, the officer will realize his mistake and quickly open the file and approve it. If you look at the responses people post to their inquiries, you would see that most responses are standard. USCIS is not just approving 140K greencards but more than a million greencards, hundreds of thousands of H1 and other visa types, EADs etc...every year. Greencards do not get issued on the day date gets current. It is not a automatic process. There is lot of human work involved and many people do not understand that or spend time understanding it. They would rather waste their time either on useless task of tracking or calling customer service every single day.
