Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

I'm a mechanical engineering and also have an MBA degree.

My lawyers tell me that I cannot apply in EB2, since my Post grad degree is unrelated to my grad degree and so does not apply to my job.
Is this true?
Can I not file in EB2?
It is better to be slow and steady and get your GC late than try to be fast and never get it ( late and fast is based on the current timelines )
If your lawyer feels it is better to go for EB3, go for EB3. Education requirements are not checked at labor stage but at I-140 stage and if you get your I-140 denied, thats a lot of hassle and trouble.

As far as i know, it dosent matter if you are on EAD or H1b. You can open a bussiness as a investor. You can have profit of that business but you can not generate your payrole or you can not work for that particular business. I will recommend to assist immigration lawyer or CPA.

Your MAVNI adjustment of status should cover your family, so they should be adjusting with you. You do not need to or have to send them to your home country.

EB3 (ROW)....PD: May 2006....
Received my REF last month then i sent my reply and they received it. Now everytime i checked the online status the Update Date in the online account is changing everyday for last couple of days. What does it mean? Is it a positive sign or not? kinda worried about the whole situation. Please let me know what you guys think or anyone get this kind of update or not?

Got a 1-797 Notice of Action today in Mail for my pending I-485 and the Notice Type: WELCOME NOTICE: SECTION: Adjustment as direct beneficiary of immigrant petition.
In the details section it says" Welcome to United States"...your application for permanent residence has been approved...we will soon mail you a new Permananet Resident Card....
HOWEVER, the online status still shows "Case pending" and NO LUD update.
1. Any reason to get concerned as the online case status still show it as Pending altough I see approval in Mail Notice?
2. Should i call customer service?
3. How long typically the card in mail takes?

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Even as several states are enacting marriage equality laws and anti-discrimination laws are moving forward around the US (including here in my home town of Memphis), the antiquated Defense of Marriage Act prevents USCIS from treating these families fairly. The UAFA would be a huge step forward. The Senate will have its first hearing on the bill tomorrow. Does anyone have any experience how long it takes to get the Canadian visa if my family members who are visiting were to travel to the Canadian Consulate in Seattle.
Earlier you used to get on the same day (in matter of hours), but apparently in March of this year, they changed their policy. "Minimum 24 hours" is not a very helpful indicator for planning :(

Applications submitted in person are accepted during our walk in hours Monday through Friday 8am to 10am. Effective March 8, 2011, applications submitted in person will no longer be processed on the same day. The minimum processing time will be 24 hours. Passports will not be returned until processing is completed. Processing times for mail in applications vary, please allow at least 4 weeks for processing. The Seattle Consulate does not provide expedited service, if you have urgent travel, it is recommended that you apply in person.

In the past, all citizens of certain countries believed to be supporters of terrorism would all be scrutinized indiscriminately. Cuba, Iran, Iraq, Pakistan, Saudi Arabia, Somalia, and Sudan are widely believed to have been on this list of soi-disant unfriendly countries. Citizens of other countries -- perceived as "friendly" to the USA -- would be subject to less scrutiny.
The new POE screening procedures use intelligence-based threat assessments. This information will be applied to all persons arriving at a POE, including Americans. If border guards have intelligence that -- let's pretend for a moment -- a university-age male student from Africa might be trying to engage in dangerous activity, then the border guards would be on the lookout for university-age male students from Africa. In contrast, university-age male students from, say, Malaysia, M�xico, Moldova, Monaco, or Myanmar would not be subject to the same scrutiny.
This new, intelligence-based approach makes the most of the information provided by US intelligence sources without painting everyone with an indiscriminately broad brush. --jcf

If you are already in US, you don't need DS-230, you need to file I-485 instead.
I-130 is an alien relative petition filed by your spouse on your behalf. I-130 has a question if you want to "adjust status while in the U.S." or go through "consular processing at an American post abroad".
If you plan to "adjust your status while in the U.S." you use form I-485. I-130/I-485 can be filed and adjudicated concurrently.
If you want to enter the U.S. as an immigrant ("consular processing" you file form DS-230 Part I with the National Visa Center and later DS-230 Part II with a consular officer at a consulate/embassy outside of the U.S.

I am having an option of joining a new employer with whom to file LC. Company is not very big 50 employees and started in 2002.
I am very worried about the stability of the company. This kind of companies are normal or I am just unneccessarily imagining and worrying ???
How to check the stability of a company before you start filing anything ???

absolutely no idea based on the info you have provided, but you need to consider a lot of things here.
1. If its a startup building the same product 5 years later, and does not seem to be expanding/growing, its probably not going to be around much longer. If its a consulting/contracting firm that works with bigger fish, it will probably be around in the future.
2. You need to also analyze your appetite or risk. If you are on 5th or 6th year of H1, then it could be risky. If its year 1/2/3/4 and you like everything else about this company, go ahead. Worst case they close in one year, you will have LC+I140 approved and can move to another company, restart GC, and recapture this old priority date.

Sec. 45. 2 Priority date of applicants.
"The priority date of an alien who is the beneficiary of a petition approved by the Service to accord status under section 124 of Public Law 101-649 shall be the filing date of the approved petition, as determined by the Immigration and Naturalization Service. The priority date of the spouse or child, accompanying or following to join such an alien shall be the priority date of the alien spouse or parent. "
As it sound to me It means PD of primary applicant will be the PD of spouse and child.

I worked under H1B (valid 11/02/2009 - 10/14/2012) with nonstop paystubs since 11/02/2009.
On 08/02/2010, some bad girl just wrote one short sentence false statement to USCIS and cancelled/revoked my H1B on 08/09/2010 secretly since she didn't notify anybody about what she had done. She also ignored 2 USCIS letters (dated 08/13/2010 and 02/04/2011 respectively) regarding the H1B cancellation.
When I was going to join a new employer in March, I was told that my H1B was "inactive" and "retracted" by USCIS. the bad girl subsiquently filed a H1B petition with nunc pro tunc requirement for me but USCIS only approved I-797B with validation period 04/14/2011 - 10/14/2012 without I-94. I have to get H-1B visa from a US consulate.
Will I be subject to 3 years ban?! Technically I have been OOS since 08/09/2010, however, I have been paid without any gap since 08/09/2010. I have nonstop paystubs since 11/02/2009. I am still being paid. The next paystub will be available on next Friday.
Will I be subject to 3 years ban?! Can I apply for a visa back?! Can I file a criminal charge against this bad girl?!
I feel hopeless until found this forum! Thanks for your helps!!!
