    The hard part about a consulting position in your scenario is the ability to keep your project pipeline flowing.

    If you are in a field like say SAP where the demand is always there, its easier to market yourself without too much effort.

    My personal opinion, note your skillsets, see if they are hot in the market and if so, keep your options flexible and try to market directly. If you are not comfortable networking or being in constant touch with resources that can help you with an opportunity, then consult under a firm...

    You are talking about taking an article and putting a perspective on it. Can you be more elaborate? If you are talking about articles being written on us, I believe there are not a lot.

    My last post in the matter. By our perspective, what I meant was, if you see an article talking about common topics such American Compititiveness or Illegal immigration you can always send an e-mail to the reporter and talk about plight legal immigrants. In most cases you will see a response from the reporter, whether they publish it or not is generally a matter of who you represent and audicences to the cause and other issues . That's why I said if IV as an organisation sends an e-mail (it could be me or you but representing IV itself) there is a possiblity that you will be taken seriously. But repeating the same issue to the same reporter 100 times will not make it any important it might even have a deleterious effect. I have seen this method working in the past. If you disagree with my approach, let's agree to dissagree on our approaches.

    What if the reporter you are writing to has an opinion similar to that of Tancredo on H1B?
    If this is the case no matter how many e-mail we send it will not have any impact on him/her. That debate is almost like Conservative vs. Liberal debate and no amount of convincing can convince the other side.

    How ever, I do not agree that we will be considered SPAM unless its the same message COPY/PASTE. 1000 emails?? Are you kidding me? I am sure it hasnt gone beyond 10 and will not go beyond 25 in the worst case.
    I thought that was what we are doing. 25, 10, 1000 are all numbers, if 1000 is a spam why 25 isn't a spam. I think it is subjective.


    Anyway, I will contact a local reporter and see how it goes, but I will not send e-mail to this editor becasue there are already e-mails sent by others conveying the same thing.

    I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).

    If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.

    Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.

    GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

    You most probably have half the education that I have, your salary is most likely half that of mine, and your moral standard is probably half that of mine. If I start ridiculing you more, you will suffer sleepless nights. So I won't do it (after this post, I mean).

    You don't post bullshit in a public forum, just because you can't see the people you are talking to, infront of you. Would you dare call the original poster 'thief' if he is standing infront of you? Would you call him that, if he is a friend of your roommate and your roommate brings him over to your house?     Isnt the goal of Education to make a person a better person, morally and otherwise? Is this what your education got you to? All of your Education (I am assuming you have four MS degrees, two PHd, as you have twice mine, and about 300K salary) is a total waste, if you stick up your head to support someone who does shop-lifting and have no qualms about it ( i have definitely not seen any statement to that effect from the OP, just seeking "immigration" advise). I can only think of a myriad number of reasons why you want to support this guy..maybe you yourself might have sticky hands my friend? Or maybe you are the same guy posting with two IDs and supporting your shop-lifting by such BS? I have no idea and am not interested either.

    Try browsing the anti-immigrant nut websites and try answering their type-casting immigrants by the acts of few, and then you will understand what i am talking about. Till, then, probably, you can take all of your fancy-a** education, fat salary and shove it up!

    Here is my recent experience,
    in the month of april my wife and I had received RFEs for 325 and birth certificate, we submitted the evidence and there was soft LUDs for almost a week, case status said a decision will be made in 60 days. I t is more than 90 days, so I called up the customer service (I very well know that they can't issue GC as the priority date is not current) I spoke to her as a layman and filed for a service request. Here is the email that I got:

    Guys,

    I efiled my AP on 9/5/10 @NSC and it was approved today after requesting expediting on 10/5/10 based on financial loss, I have a business transaction back home for which i need to be present and provided all supporting documentation related to that.

    This is what is think is more effective than contacting senators/Ombudsman for expediting, resend all the I-131 supporting documentation,proof of emergency/loss, 2 photos and include a cover letter with bold colorful fonts requesting expediting to the same address you sent your app earlier (btw, i used the USCIS center courier address and not PO Box address), i believe this way your app goes to the officer quicker and he has all the documents needed to approve your case right away if you qualify for expediting, i have used this process more than once and know it works at least for me....you have tried other methods, why not try this as well!

    AP Filed/Reciept date: June 1, 2010
    Created an SR request : ~ September 20, just got standard email saying Intial Review is still in progress.

    We have an Info-pass appointment tomorrow. We chose the 45 day not response option. Not sure if that is ok when we get there.

    Is there anything else I need to know before I meet a rep during the Infopass appointment.

    We plan to take all relevant documents, along with a copy of email from a conference in Canada where my wife is invited.

    Any input will be great.

    And always send via USPS express mail. (1 day costed me $18) but I came to know instantly the next day that they received it.
    You could also use some cheaper USPS option. as long as it has some delivery confirmation.
    The reason I like express mail one day, is because u can request a copy of the receiver's signature via email (comes in a PDF). This is proof that USCIS really got it and u can then sleep nicely for the next 3 months.

    Hey guys,
    I have a question to all of you...

    AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.

    For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
    I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.

    I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...

    Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .

    AILA has expanded the definition of the plaintiff to cover all the july filings but it does not mean that you will be beneficiary if you have just filed in July. You either have to be a plaintiff or member of the class action (if judge allows). That also does not guarantee that you will get the benefit if lawsuit is won. As per AILF, only limited number of visa will be made available upon winning the lawsuit and that will cover only people who filed early in July. All depends upon number of visa made available, number of applications filed and out of those how many are part of class action lawsuit.

    See this excerpts from immigration-law:-
    The AILF is currently developing a lawsuit against the USCIS and the DOS. As reported earlier, apparently the AILF has been successful in finding the potential plaintiffs for the lawsuit. The plaintiffs will automatically become members of the class in the class action who will get the relief if they win in the lawsuit. The details of the relief this lawsuit is pursuing are articulated in the AILF's Visa Bulletin Lawsuit FAQ. For the summary, please click here.
    The lawsuit team lawyers are still developing the strategies and details of the members of the class this lawsuit will cover who are not members of the plaintiffs. As they move along, the details can be changed, but according to the FAQ, membership of the class would require filing of EB I-485 applications in July 2007. Accordingly, those who fail to file EB I-485 applications are likely not included in the membership and will not be able to receive the fruits of the litigation, once the class wins in the litigation. Relevant to the issue of when the EB I-485 should be filed to receive the benefit as a class member is the number of July visa numbers which will be made available to the members of the winning class of the lawsuit. Obviously, the visa numbers will be limited in numbers. The members of the class will have to compete each other for the numbers. According to the FAQ, the number will be taken under the principle First In First Out bases. Accordingly, the earlier his/her EB I-485 is filed, the better the chance of getting the number before they are exhausted. It appears that those who fail to get the numbers are likely to be left out of any benefits of the litigation.
    It thus appears that some people may want to file the EB I-485 applications with the full knowledge that the applications will be rejected and returned by the USCIS, just to become a member of the class of this lawsuit. Consdering the fact that some visa numbers may become available in October 2007 for certain people, they may be less desperate and eager in seeking membership of the class of the lawsuite. While, the nationals of ovesubscribed countries such as India, China, Mexico, and Philippines will need the fruits of this litigation much more desperately than the people from other countries. Additionally, EB-3 people may have such need more than EB-1 or EB-2 since when new visa numbers become available in October, the EB-3 numbers are likely more oversubscribed than EB-1 and EB-2. Lastly, the lower the priority date is, the more they will need the fruit of the litigation as the higher priority date applicants will have a better chance to get their priority date becoming current in October or soon thereafter. These variants should give a guide to the people to determine whether or not they should file EB I-485 applications to become a member of the class.
    However, these factors alone should not be considered absolute determinants in deciding whether they should file the EB I-485 applications in July. The FAQ indicates that the downside of becoming a member of the class by filing EB I-485 applications in July is potential extensive and in-depth scrutiny of the cases by the USCIS to weed out the applicants on the ground of ineligibility of I-485 applications. Accordingly, people with some potential issues of whatever nature may be considered poor candidates for the membership of the class. The straight forward case should be considerred a better candidate for filing EB I-485 applications in July, while those with some potential wrinkes in the case may stay away from filing the application in July.
    For the foregoing reasons, people should seek assessment of one's case by legal counsel for appropriateness of filing EB I-485 now and becoming a potential member of the class of the lawsuit. It is absolutely no and no to jump into filing the applications without the appropriate legal counsel.

    What does what mean? You can upgrade to PP whenever USCIS makes it available....August 1st or at a later date.

    You are correct when you look at early years only. But for the longer term whole life is better. Yes for short term Whole life can be very bad.

    Pros:

    Predictable, in most cases premiums are fixed for the life of the insured.
    The beneficiaries receive the death benefit no matter when the insured dies, as long as premiums were paid.
    The policy may build up cash value, which grows tax deferred.
    If you surrender the policy at a later date, the cash value, if any, will be returned to you.
    If you stop making premium payments you can receive the cash value or use that cash value to provide a paid up insurance benefit. The company must provide either extended term insurance coverage or reduced paid paid-up coverage. While it is not required that both options be offered many companies do make both available.

    Cons:

    A more complex product than term life insurance.
    Higher premiums than term life insurance.
    Could be costly if coverage lapses early. (You don't want to cancel early and if you are not sure then never take Whole Life. If you are planning for long term only then take Whole life)

    I just got off the call from uscis regarding my I-485. My PD is in the first week of Mar 2006.

    Per the USCIS website, they are suppose to process even the first week of Mar 2006 although the Aug VB says it is 01MAR06. I spoke to the second level IO and he was confident that my case would have to wait for the next month. I insisted that the uscis website says otherways, he went and verified with the third level (or his peer) and came back and told me that I was correct.
    Infact told me that my case was pre-adjd and being reviewed by IO currently.

    I am sure the same applies to you with the Sep VB. Good luck !!!

    Yes, you are right. Cases are assigned (not picked), which is done in order they were physically received at the center they are being assigned at. If PD is not current, case is put aside and next file is considered. Due to huge filings in July'07, resultant chaos, and shuffling cases around between centers before entering them in the system, if your file is way below in line (eventhough you deligently made sure to have it with USCIS on July 2, AND your PD is current), no one is going to look at your file, until your turn (in order of final data entry) reaches.

    If I recall correctly, I saw many posts about people called to ask about their 485 case status. And many got response as NC is cleared, waiting to be assigned to a IO and/or waiting for visa number.
    That is why I think when you are current, you are then have a chance to be assigned to an IO, and then be able to get a visa number. I don't think cases have been assigned to IO when CIS receive your I-485 form. And if you look at 's data, many of old PD have been approved, even if their RD is 2008. So I think RD only plays a rule as control how many people can do SR. It is not matter about they will process your case if you are within processing time at all. When your PD is current, you have a chance.

    On Ron's website, he talks about this move in Feb. He thinks there's not enough cases processed(not meet VO's goal) for EB2 China and India, that is why dates move forward. For EB-3, CIS meets VO's goal for the month so VO doesn't advance the date.
